{"data":{"id":"us-ky/krs-205.6407","jurisdiction":"us-ky","citation":"KRS 205.6407","heading":"Hospital Medicaid assessment fund.","body":"(1) There is hereby established in the State Treasury the hospital Medicaid assessment\nfund for the purpose of holding assessments collected under KRS 205.6406 and\nfunds transferred pursuant to KRS 205.6408.\n(2) All assessments collected shall be deposited int o the fund and transferred to the\ndepartment on a quarterly basis to be distributed only for the purpose of\nadministering the provisions of KRS 205.6406.\n(3) Any fund amounts remaining in the fund after the cessation of the collection of the\nassessment under KRS 205.6406 shall be refunded to qualifying hospitals on a pro\nrata basis based upon the assessments paid by each qualifying hospital for the\nprogram year that ended immediately before the cessation of the collection of the\nassessment.\n(4) Notwithstanding KRS 45.229, fund amounts not expended at the close of a fiscal\nyear shall not lapse but shall be carried forward into the next fiscal year and shall be\nused to reduce the assessments in the subsequent program year.\n(5) Any interest earnings of the fund shall become a part of the fund and shall not lapse.\n(6) Moneys deposited into the fund are hereby appropriated for the purposes set forth in\nthis section and shall not be appropriated or transferred by the General Assembly\nfor any other purpose.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48911","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"6cd1b566beba54780701985d20dcbcd6ce5053f1525f8abd704833923be37748","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.6406","next":"us-ky/krs-205.6408"},"notice":"GroundRules: Original legal text.
