{"data":{"id":"us-ky/krs-205.642","jurisdiction":"us-ky","citation":"KRS 205.642","heading":"Pervasive developmental disorders -- Definition for KRS  200.654,","body":"200.660, 347.020, and 387.510 -- Waiver application -- Report.\n(1) As  used in this section and KRS  200.654, 200.660, 347.020, and 387.510,\n\"pervasive developmental disorders\" has  the same  meaning  as  in the\nDiagnostic and Statistical Manual of Mental Disorders, fourth edition (DSM-IV).\nThe term includes five (5) diagnostic subcategories:\n(a) Autistic disorder;\n(b) Pervasive disorder not otherwise specified;\n(c) Asperger's disorder;\n(d) Rett's disorder; and\n(e) Childhood disintegrative disorder.\n(2) The Department for Medicaid Services shall make application, within three (3)\nmonths  of July 15, 2002, to the Federal Centers for Medicare and Medicaid\nServices for a waiver to provide services and supports to individuals who:\n(a) Are Medicaid eligible;\n(b) Have an Axis I diagnosis of a pervasive developmental disorder;\n(c) Are institutionalized or at risk for institutionalization; and\n(d) Require a coordinated plan of medically necessary community-based\nbehavioral health services.\n(3) The  waiver application shall include services that are documented  to be\neffective in the treatment of pervasive developmental disorders and consistent\nwith clinical best practices.\n(4) The waiver application shall specify the required credentials for the providers of\neach service.\n(5) The cabinet shall cap the number of children served under the waiver program\nto insure budget neutrality based upon the expenditures for children with\nPervasive Developmental Disorders that were served under the IMPACT  Plus\nProgram during fiscal years 2001-2002.\n(6) The  cabinet shall include in the waiver application those items that are\nnecessary  to ensure the waiver operates within the designated dollars,\nincluding but not limited to a maximum  number of individuals to be served and\na maximum  dollar amount that can be expended for an individual.\n(7) The waiver shall be coordinated with and shall not supplant services provided\nby schools under KRS  Chapter 157 or services provided under KRS  Chapters\n200 and 347. Nothing in this section shall affect or limit a school district's ability\nto obtain Medicaid reimbursement for school-related health services.\n(8) The Department for Medicaid Services shall report information on the number\nof individuals receiving services under the waiver, the cost and type of services\nreceived, and any available nonidentifying information pertaining to individual\noutcomes upon request.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46323","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"de3db96d73957b2bdbd4dd810fd9c7db499261e43cf5aac53c1e6154b4dfa299","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.6412","next":"us-ky/krs-205.643"},"notice":"GroundRules: Original legal text.
