{"data":{"id":"us-ky/krs-205.8459","jurisdiction":"us-ky","citation":"KRS 205.8459","heading":"Emergency service.","body":"(1) Any provider presented with a request for an emergency service, for a nonlife -\nthreatening condition or a condition that would not result in irreparable harm, by a\nMedicaid recipient participating in a managed care program but not in a restricted\nMedicaid s tatus, shall not provide the service on an emergency basis unless the\nprovider first makes a reasonable effort to contact the recipient's designated\nmanaged care primary physician for prior approval. Any provider presented with a\nrequest for an emergency s ervice, due to a life -threatening condition or a condition\nthat would result in irreparable harm, by a Medicaid recipient participating in a\nmanaged care program but not in a restricted Medicaid status, may provide the\nservice without prior approval from the recipient's designated managed care primary\nphysician.\n(2) For the purposes of implementing KRS 205.8455, 205.8457, and this section, the\nDepartment for Medicaid Services, in consultation with the Recipient Utilization\nReview Committee, shall in conform ity with the federal Emergency Medical\nTreatment and Active Labor Act (42 U.S.C. sec. 1395dd, as amended) and any other\napplicable federal law, and in administrative regulation promulgated pursuant to\nKRS Chapter 13A, define an emergency service, irreparable harm, immediate grave\nbodily harm, life-threatening condition, and nonlife-threatening condition.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7855","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:05Z","sha256":"68ae6c69e9701015585c5ad69c5d4182d3562598ac742f28c54d26778d7c8555","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.8457","next":"us-ky/krs-205.8461"},"notice":"GroundRules: Original legal text.
