{"data":{"id":"us-ky/krs-205.8463","jurisdiction":"us-ky","citation":"KRS 205.8463","heading":"Fraudulent acts -- Penalties.","body":"(1) No person shall knowingly or wantonly devise a scheme or plan a scheme or\nartifice, or enter into an agreement, combination, or conspiracy to obtain or aid\nanother in obtaining payments from any medical assistance program under this\nchapter by means of any fictitious, false, or fraudulent application, claim, report, or\ndocument submitted to the Cabinet for Health and Family Services, or intentionally\nengage in conduct which advances the scheme or artifice.\n(2) No person shall intentionally, knowingly, or wantonly make, present, or cause to be\nmade or presented to an employee or officer of the Cabinet for Health and Family\nServices any false, fictitious, or fraudulent statement, representation, or entry in any\napplication, claim, report, or document used in d etermining rights to any benefit or\npayment.\n(3) No person shall, with intent to defraud, knowingly make, or induce, or seek to\ninduce the making of a false statement or false representation of a material fact with\nrespect to the conditions or operations o f an institution or facility in order that the\ninstitution or facility may qualify, upon initial certification or upon recertification,\nas a hospital, skilled -nursing facility, intermediate -care facility, home -health\nagency, or other provider of services to the Medical Assistance Program.\n(4) No person shall, in any matter within the jurisdiction of the Cabinet for Health and\nFamily Services under this chapter, knowingly falsify, conceal, or cover up by any\ntrick, scheme, or device a material fact, or make any false, fictitious, or fraudulent\nstatement or representation, or make or use any false writing or document knowing\nthe same to contain any false, fictitious, or fraudulent statement or entry.\n(5) (a) Any person who violates subsections (1) and (2) of t his section shall be guilty\nof a Class B misdemeanor unless:\n1. The sum total of benefits or payments claimed in any application, claim,\nreport, or document, or in any combination or aggregation thereof, is\nvalued at five hundred dollars ($500) or more but less than one thousand\ndollars ($1,000), in which case it is a Class A misdemeanor;\n2. The sum total of benefits or payments claimed in any application, claim,\nreport, or document, or in any combination or aggregation thereof, is\nvalued at or above one th ousand dollars ($1,000), in which case it is a\nClass D felony; or\n3. The person has three (3) or more convictions under subparagraph 1. of\nthis paragraph within the last five (5) years, in which case it is a Class D\nfelony. The five (5) year period shall b e measured from the dates on\nwhich the offenses occurred for which the judgments of conviction were\nentered.\n(b) If any person commits two (2) or more separate violations of subsections (1)\nand (2) of this section within ninety (90) days, the offenses may be combined\nand treated as a single offense, and the value of the property in each offense\nmay be aggregated for the purpose of determining the appropriate charge.\n(6) Any person who violates the provisions of subsection (3) of this section shall be\nguilty of a Class C felony.\n(7) Any person who violates the provisions of subsection (4) of this section shall be\nguilty of a Class D felony.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51031","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:05Z","sha256":"7a335b475d398c95a4246d4d464c2be287c4441a055c010ceda1c4a98fa14176","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.8461","next":"us-ky/krs-205.8465"},"notice":"GroundRules: Original legal text.
