{"data":{"id":"us-ky/krs-205.8467","jurisdiction":"us-ky","citation":"KRS 205.8467","heading":"Liability of violators -- Payment of penalties to Medicaid trust fund.","body":"(1) Any provider who has been found by a preponderance of the evidence in an\nadministrative process, in conformity with any applicable federal regulations and\nwith due process protections, to have knowingly submitted or caused claims to be\nsubmitted for payment for furnishing treatment, services, or goods under a medical\nassistance program provided under this chapter, which payment the provider was\nnot entitled to receive by reason of a violation of this chapter, shall:\n(a) Be liable for restitution of any pay ments received in violation of this chapter,\nand interest at the maximum legal rate pursuant to KRS 360.010 in effect on\nthe date any payment was made, for the period from the date payment was\nmade to the date of repayment to the Commonwealth;\n(b) Be liable for a civil payment in an amount up to three (3) times the amount of\nexcess payments;\n(c) Be liable for payment of a civil payment of five hundred dollars ($500) for\neach false or fraudulent claim submitted for providing treatment, services, or\ngoods;\n(d) Be liable for payment of legal fees and costs of investigation and enforcement\nof civil payments; and\n(e) Be removed as a participating provider in the Medical Assistance Program for\ntwo (2) months to six (6) months for a first offense, for six (6) month s to one\n(1) year for a second offense, and for one (1) year to five (5) years for a third\noffense.\n(2) Civil payments, interest, costs of investigation, and enforcement of the civil\nremedies recovered on behalf of the Commonwealth under this section shall  be\nremitted to the State Treasurer for deposit in a Medicaid trust fund which is hereby\ncreated and shall not lapse. Funds deposited in the Medicaid trust fund shall not be\nspent until appropriated by the General Assembly for medical assistance services.\n(3) The remedies under this section are separate from and cumulative to any other\nadministrative, civil, or criminal remedies available under federal or state law or\nregulation.\n(4) The Cabinet for Health and Family Services, in consultation with the Offic e of the\nAttorney General, may promulgate administrative regulations, pursuant to KRS\nChapter 13A, for the administration of the civil payments contained in this section.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7859","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:05Z","sha256":"35fe75c989de627cfc28a6041073d226fac61cb034745399f9ea65cc2565f411","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.8465","next":"us-ky/krs-205.8469"},"notice":"GroundRules: Original legal text.
