{"data":{"id":"us-ky/krs-205.8475","jurisdiction":"us-ky","citation":"KRS 205.8475","heading":"Forfeiture of provider's license.","body":"(1) Any professional, licensed or regulated by any agency of the Commonwealth of\nKentucky, who upon final and unappealable decision by a court of competent\njurisdiction, is convicted or pleads guilty to a violation of any of the criminal\nprovisions of KRS 205. 8451 to 205.8483, shall, in addition to any other penalty\nprovided by law, forfeit the license to practice his or her profession for a mandatory\nminimum period of five (5) years. The license to practice a profession shall be\nreinstated only after complianc e with all conditions for reinstatement contained in\nadministrative regulations of the applicable licensure or regulatory board or agency\npromulgated pursuant to the provisions of KRS Chapter 13A. For purposes of this\nsubsection, an individual or entity is  considered to have been \"convicted\" of an\noffense when:\n(a) A judgment of conviction has been entered against the individual or entity by\na federal or state court;\n(b) There has been a finding of guilt against the individual or entity by any court\nof competent jurisdiction;\n(c) A plea of guilty by the individual or entity has been accepted by any court of\ncompetent jurisdiction; or\n(d) The individual or entity has entered into participation in a court imposed first\noffender, deferred adjudication, diversio n, or other arrangement or program\nwhere judgment of conviction has been withheld.\n(2) Pending the final and unappealable decision of a court of competent jurisdiction, as\nprovided under subsection (1) of this section, the provider shall not be eligible to\nparticipate in the Kentucky Medical Assistance Program.\n(3) No provider, owner, officer, or stockholder possessing more than forty percent\n(40%) of the shares of a provider shall receive payments for medical services or\nreceive profits or remuneration fro m any other medical assistance provider with\nwhich the provider, owner, officer, or stockholder may thereafter become associated\nuntil all criminal penalties or civil payments assessed against the provider, owner,\nofficer, or stockholder under KRS 205.8451 to 205.8483 have been satisfied.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7863","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:05Z","sha256":"6c25a22e78fcc93602f31cfa747f8c24504b82a40290cceb13fd84b11e7325a5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.8473","next":"us-ky/krs-205.8477"},"notice":"GroundRules: Original legal text.
