{"data":{"id":"us-ky/krs-205.905","jurisdiction":"us-ky","citation":"KRS 205.905","heading":"Subsidy for personal care assistance.","body":"(1) The cabinet shall provide a subsidy for personal care assistance services to any adult\nwho:\n(a) Has a severe physical disability;\n(b) Needs not less than fourteen (14) hours a week of personal care assistance\nservices as defined by the secretary or needs  an attendant at night, which\nservices are necessary to prevent or remove the adult from inappropriate\nplacement in an institutional setting; and\n(c) Qualifies under KRS 205.910.\n(2) The adult shall be responsible for:\n(a) Recruiting, hiring, firing and  supervising the persons who provide personal\ncare assistance services; and\n(b) Obtaining an evaluation of his eligibility for personal care services from a\nqualified agency or organization which employs evaluation teams to:\n1. Determine the eligibility of the adult for personal care assistance\nservices;\n2. Reevaluate the adult at least biennially to determine the adult's\ncontinuing need for services; and\n3. Report its findings and recommendations to the cabinet.\n(3) The cabinet shall follow the recomm endations of the evaluation team or shall give\nnotice to the adult within twenty (20) days of receipt of the recommendations of its\nreasons for not acting on the team's recommendations.\n(4) The cabinet may maintain a list of qualified agencies and organizations.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7871","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:05Z","sha256":"5b32c785393735c4d793c6230dcce7238d3dbdfc70cfec4ce9f8c8812b1d22e5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.900","next":"us-ky/krs-205.910"},"notice":"GroundRules: Original legal text.
