{"data":{"id":"us-ky/krs-209.100","jurisdiction":"us-ky","citation":"KRS 209.100","heading":"Emergency protective services.","body":"(1) If an adult lacks the capacity to consent to receive protective services in an\nemergency, these services may be ordered by a court on an emergency basis through\nan order pursuant to KRS 209.110, provided that:\n(a) The adult is in a state of abuse or neglect and an emergency exists;\n(b) The adult is in need of protective services;\n(c) The adult lacks the capacity to consent and refuses to consent to such services;\nand\n(d) No person authorized by law or court order to give consent for the adult is\navailable to consent to emergency protective services or such person refuses to\ngive consent.\n(2) In ordering emergency protective services, the court shall authorize only that\nintervention which it finds to be the least restrictive of the individual's liberty and\nrights while consistent with his welfare and safety.","path":["KRS Chapter 209"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8190","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:09Z","sha256":"ffcb255a070e2c96fb93d28eb703d5841b846115dcaf4885ef1de0dbd504084c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-209.090","next":"us-ky/krs-209.110"},"notice":"GroundRules: Original legal text.
