{"data":{"id":"us-ky/krs-209.115","jurisdiction":"us-ky","citation":"KRS 209.115","heading":"Disqualification from serving in fiduciary capacity for felony conviction","body":"under KRS Chapter 209.\n(1) Any person convicted of a felony under this chapter shall be disqualified from being\nappointed or serving as a guardian, limited guardian, conservator , limited\nconservator, executor, administrator, fiduciary, personal representative, attorney -in-\nfact, or health care surrogate as to the victim of the offense or the victim's estate.\nThe sentencing judge shall inform the defendant of the provisions of this  section at\nsentencing.\n(2) Any interested person or entity, as that phrase is defined in KRS 387.510, shall have\nstanding to contest the appointment or continued service of a person subject to the\nprohibition established in subsection (1) of this section.\n(3) Actions of a guardian, limited guardian, conservator, limited conservator, executor,\nadministrator, fiduciary, personal representative, attorney -in-fact, or health care\nsurrogate disqualified from acting in that capacity due to the provisions of\nsubsection (1) of this section shall remain valid as to third parties acting in good\nfaith and without knowledge of the person's disqualification.","path":["KRS Chapter 209"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39694","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:09Z","sha256":"9598f8088c6b86cdde63f0ac328006f72ee0fc3d6cfe73e99f8fff97dddfc05d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-209.110","next":"us-ky/krs-209.120"},"notice":"GroundRules: Original legal text.
