{"data":{"id":"us-ky/krs-209.552","jurisdiction":"us-ky","citation":"KRS 209.552","heading":"Immunization against pneumococcal disease and influenza --","body":"Documentation -- Immunization of employees.\n(1) Every long -term care facility shall require residents to be immunized against\npneumococcal disease and influenza. Upon admission, the l ong-term care facility\nshall:\n(a) Notify the resident of the requirements of this section and request that the\nresident agree to be immunized against pneumococcal disease and influenza\nvirus;\n(b) Assess the resident's immunization status for influenza viru s and\npneumococcal disease;\n(c) Counsel each resident on the risks of influenza and pneumococcal disease; the\nefficacy, side effects, and contraindications of these immunizations; and the\nrecommendations of the Centers for Disease Control prior to administration of\nthe vaccines; and\n(d) Provide or arrange for immunizations against pneumococcal and influenza in\naccordance with the recommendations of the Advisory Committee on\nImmunization Practices of the Centers for Disease Control, unless medically\ncontraindicated, if the resident or long -term care facility does not have\ndocumentation of the immunization.\n(2) Every long-term care facility shall document immunization against influenza virus\nevery influenza season, by October 15 or upon admission, whichever co mes later,\nand pneumococcal immunization for each resident. Upon finding that a resident\nlacks either of these immunizations, the facility shall provide or arrange for the\nimmunization in accordance with the recommendations of the Advisory Committee\non Imm unization Practices of the Centers for Disease Control, unless medically\ncontraindicated.\n(3) Every long-term care facility shall require each employee, regardless of employment\nstatus, to be immunized against pneumococcal and influenza virus. Upon\nemployment, the long-term care facility shall:\n(a) Notify the employee of the requirements of this section and request that the\nemployee agree to be immunized against pneumococcal disease and influenza\nvirus;\n(b) Assess the employee's immunization status for infl uenza virus and\npneumococcal disease;\n(c) Counsel each employee on the risks of influenza and pneumococcal disease;\nthe efficacy, side effects, and contraindications of these immunizations; and\nthe recommendations of the Centers for Disease Control prior t o\nadministration of the vaccines; and\n(d) Provide or arrange for immunizations against pneumococcal and influenza in\naccordance with the recommendations of the Advisory Committee on\nImmunization Practices of the Centers for Disease Control, unless medicall y\ncontraindicated, if the employee or the long -term care facility does not have\ndocumentation of the appropriate immunizations.\n(4) Every long-term care facility shall document immunization against influenza virus\nevery influenza season, by October 15 or upon employment, whichever comes later,\nand pneumococcal immunization for each employee. Upon finding that an\nemployee lacks either of these immunizations, the facility shall provide or arrange\nfor immunization in accordance with the recommendations of the Advisory\nCommittee on Immunization Practices of the Centers for Disease Control, unless\nmedically contraindicated.\n(5) The provisions of this section shall not apply if:\n(a) The vaccine is medically contraindicated;\n(b) The employee, resident, or resident's legal guardian objects to the\nimmunizations due to religious beliefs; or\n(c) The employee or resident refuses the vaccine after being fully informed of the\nhealth risks.","path":["KRS Chapter 209"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50019","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:10Z","sha256":"173318e6da03e43dc20f8deb39e30872e2d92ad6b819cf432405b06c334f947e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-209.550","next":"us-ky/krs-209.554"},"notice":"GroundRules: Original legal text.
