{"data":{"id":"us-ky/krs-21.425","jurisdiction":"us-ky","citation":"KRS 21.425","heading":"Benefits to surviving or disabled children of members who began","body":"participating before January 1, 2014 -- Designation of beneficiaries.\n(1) In any circumstances in which a surviving spouse would be entitled to any\nallowance under KRS 21.420, b ut there is no surviving spouse or the surviving\nspouse subsequently dies, and there is a surviving child or children of the member\nunder the age of twenty -one (21), or there is a disabled child or children, the\nmonthly allowance that the surviving spouse would have received or was receiving\nshall be continued, as follows:\n(a) If the member does not have a disabled child or children, the benefit shall\ncontinue until there are no children remaining under the age of twenty -one\n(21); or\n(b) If the member has a disabled child or children, the benefit shall continue until\nthe death of the last remaining disabled child.\n(2) A member may designate his or her child or children under the age of twenty -one\n(21), or his or her disabled child or children, or a special n eeds trust as defined by\nKRS 21.420(9) for the benefit of the disabled child, to receive the death benefit\npayable under KRS 21.420 instead of his or her spouse, or he or she may designate\nthat his or her spouse shall receive a percentage of the death bene fit, and his or her\nchild or children under the age of twenty -one (21), or his or her disabled child or\nchildren, or a special needs trust as defined by KRS 21.420(9) for the benefit of a\ndisabled child, shall receive the remainder. The member making such a choice shall\ndesignate his or her beneficiary or beneficiaries in writing to the manager of the\nJudicial Form Retirement System on a form provided by the manager.\n(3) For purposes of this section, \"disabled\" means an individual determined by the\nSocial Security Administration to be entitled to total disability benefits.\n(4) Subsections (1) to (3) of this section shall not apply to a member who begins\nparticipating in the Judicial Retirement Plan on or after January 1, 2014.","path":["KRS Chapter 21"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57219","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:41Z","sha256":"a6df606e2050b091ac85be68562324062b36f27da5e02eab0b10a8257173182a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-21.420","next":"us-ky/krs-21.427"},"notice":"GroundRules: Original legal text.
