{"data":{"id":"us-ky/krs-210.005","jurisdiction":"us-ky","citation":"KRS 210.005","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Cabinet\" means the Cabinet for Health and Family Services;\n(2) \"Chronic\" means that clinically significant symptoms of mental illness have\npersisted in the individual for a continuous per iod of at least two (2) years, or that\nthe individual has been hospitalized for mental illness more than once in the last\ntwo (2) years, and that the individual is presently significantly impaired in his\nability to function socially or occupationally, or both;\n(3) \"Deaf or hard -of-hearing\" means having a hearing impairment so that a person\ncannot hear and understand speech clearly through the ear alone, irrespective of the\nuse of any hearing aid device;\n(4) \"Individual with an intellectual disability\" means  a person with significantly\nsubaverage general intellectual functioning existing concurrently with deficits in\nadaptive behavior and manifested during the developmental period;\n(5) \"Mental illness\" means a diagnostic term that covers many clinical categor ies,\ntypically including behavioral or psychological symptoms, or both, along with\nimpairment of personal and social function, and specifically defined and clinically\ninterpreted through reference to criteria contained in the Diagnostic and Statistical\nManual of Mental Disorders (Third Edition) and any subsequent revision thereto, of\nthe American Psychiatric Association;\n(6) \"Regional community services program\" means a community services program for\nmental health or individuals with an intellectual disability established in accordance\nwith this chapter, a community mental health center, a certified community\nbehavioral health clinic, or a certified eligible community behavioral health clinic;\nand\n(7) \"Secretary\" means the secretary of the Cabinet for Health and Family Services.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54182","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:10Z","sha256":"f8230f3071c42e3938f7bad6c3572cad18a24567ba1a53c17611b5c36d1a5dee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-21.990","next":"us-ky/krs-210.010"},"notice":"GroundRules: Original legal text.
