{"data":{"id":"us-ky/krs-210.040","jurisdiction":"us-ky","citation":"KRS 210.040","heading":"Powers and duties of cabinet.","body":"The Cabinet for Health and Family Services shall:\n(1) Exercise all functions of the state in relation to the administration and operation of\nthe state facilities for the care and treatment of persons with mental illness;\n(2) Establish or acquire, in accord ance with the provisions of KRS 56.440 to 56.550,\nother or additional facilities for psychiatric care and treatment of persons who are or\nmay become state charges;\n(3) Cooperate with other state agencies for the development of a statewide mental\nhealth program looking toward the prevention of mental illness and the aftercare of\npersons released from public or private mental hospitals;\n(4) Provide for the custody, maintenance, care, and medical and psychiatric treatment\nof the patients of the facilities oper ated by the cabinet, including emergency and\nother medical care required to be provided outside of the facility while the patient is\nadmitted to the facility. Expenses of the outside medical provider, other than\nelective procedures or elective surgery, sha ll be paid by the cabinet and included in\nthe determination of the patient liability when not covered by the patient's third -\nparty payor;\n(5) Provide psychiatric consultation for the state penal and correctional institutions, and\nfor the state facilities o perated for children or for persons with an intellectual\ndisability;\n(6) Administer and supervise programs for the care of persons with mental illness\noutside of state facilities;\n(7) Administer and supervise programs for the care of persons with chronic m ental\nillness, including but not limited to provision of the following:\n(a) Identification of persons with chronic mental illness residing in the area to be\nserved;\n(b) Assistance to persons with chronic mental illness in gaining access to\nessential mental health services, medical and rehabilitation services,\nemployment, housing, and other support services designed to enable persons\nwith chronic mental illness to function  outside inpatient facilities to the\nmaximum extent of their capabilities;\n(c) Establishment of community -based transitional living facilities with twenty -\nfour (24) hour supervision and community -based cooperative facilities with\npart-time supervision; pro vided that, no more than either one (1) transitional\nfacility or one (1) cooperative facility may be established in a county\ncontaining a city of the first class or consolidated local government with any\nfunds available to the cabinet;\n(d) Assurance of the  availability of a case manager for each person with chronic\nmental illness to determine what services are needed and to be responsible for\ntheir provision; and\n(e) Coordination of the provision of mental health and related support services\nwith the provis ion of other support services to persons with chronic mental\nillness;\n(8) Require all providers who receive public funds through state contracts, state grants,\nor reimbursement for services provided to have formalized quality assurance and\nquality improvement processes, including but not limited to a grievance procedure;\nand\n(9) Supervise private mental hospitals receiving patients committed by order of a court.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57642","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:10Z","sha256":"d8742027f09c0ddfa7dea9741318b5ff3461c1948d7496edc9b3bdd265863e92","source_id":"us-ky","stale":false,"prev":"us-ky/krs-210.035","next":"us-ky/krs-210.042"},"notice":"GroundRules: Original legal text.
