{"data":{"id":"us-ky/krs-210.300","jurisdiction":"us-ky","citation":"KRS 210.300","heading":"Designation of hospital districts -- Guidelines -- Administrative regulations","body":"-- Annual review.\n(1) The secretary of the Cabinet for Health and Family Services shall promulgate\nadministrative regulations no later than October 1, 2022, in acco rdance with KRS\nChapter 13A establishing hospital districts, for the purpose of determining to which\nof the state institutions or contracted hospitals for the mentally ill the persons\nadmitted from each county shall initially be sent.\n(2) In establishing t he hospital districts under subsection (1) of this section, the\nsecretary shall consider the:\n(a) Distance and travel time from each county to a state institution or contracted\nhospital for the mentally ill;\n(b) Need to transport the individual to a hospit al or psychiatric facility to secure\nan evaluation or for admission without unnecessary delay as required under\nKRS Chapters 202A, 202B, and 202C; and\n(c) Population of the hospital districts based upon the most recent federal\ndecennial census.\n(3) The secretary shall also establish and maintain a list of local hospitals containing a\npsychiatric unit or crisis stabilization unit approved by the cabinet to which\nindividuals may be transported and admitted as an alternative to a state institution\nor contracte d hospital for the mentally ill when clinically appropriate due to\ncircumstances that include but are not limited to:\n(a) The ability or inability of the designated state institution or contracted hospital\nto accept the individual to be transported or eval uated without delay due to\ncapacity limitations, lack of staffing, or other impediment; or\n(b) The need for immediate and emergent treatment or evaluation arising from\nbut not limited to the threat or reasonable fear of physical harm to the\nindividual or any employee or agent of the transporting agency or service.\nOnly those hospitals that have filed a written notice with the cabinet of the\nhospital's willingness to accept patients under this subsection may accept\nadmissions.\n(4) The secretary shall review  the hospital districts on an annual basis to ensure\ntransports and evaluations occur without unnecessary delay as required under this\nsection and KRS Chapters 202A, 202B, and 202C, and shall provide a report to the\nInterim Joint Committee on Health Servic es and the Interim Joint Committee on\nJudiciary on or before October 1, 2022, and on or before October 1 of each year\nthereafter. The report shall, at a minimum, include:\n(a) Any changes made to any hospital district and the reason for the change;\n(b) The name and location of state institutions accepting patients for admission\nunder KRS Chapters 202A, 202B, and 202C, including the counties the state\ninstitution serves; and\n(c) The name and locations of any contracted hospital accepting patients for\nadmission under KRS Chapters 202A, 202B, and 202C, including the counties\nthe contracted hospital serves.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53690","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:10Z","sha256":"25a56b037d5490343f4507e8a09e4cd2498d1d792e6fb87df61d8206ee72bc9e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-210.290","next":"us-ky/krs-210.310"},"notice":"GroundRules: Original legal text.
