{"data":{"id":"us-ky/krs-210.370","jurisdiction":"us-ky","citation":"KRS 210.370","heading":"Service areas for regional community services programs -- Cities or","body":"counties may join in providing programs for mental health or individuals with\nan intellectual disability -- Operating as behavioral health services\norganization when outside regi onal service area -- Expansion of out -of-region\nservices -- Assistance from other service areas -- Collaborative request --\nReimbursement for services outside area.\n(1) The following fifteen (15) regional service areas for regional community services\nprograms are hereby created and established:\n(a) Regional service area one (1), which shall include the counties of Ballard,\nCarlisle, Hickman, Fulton, McCracken, Graves, Marshall, Livingston, and\nCalloway;\n(b) Regional service area two (2), which shall inc lude the counties of Crittenden,\nLyon, Caldwell, Hopkins, Muhlenberg, Trigg, Christian, and Todd;\n(c) Regional service area three (3), which shall include the counties of Union,\nHenderson, Webster, McLean, Daviess, Ohio, and Hancock;\n(d) Regional service a rea four (4), which shall include the counties of Logan,\nSimpson, Butler, Warren, Edmonson, Hart, Barren, Allen, Metcalfe, and\nMonroe;\n(e) Regional service area five (5), which shall include the counties of\nBreckinridge, Meade, Grayson, Hardin, Larue, Nels on, Washington, and\nMarion;\n(f) Regional service area six (6), which shall include the counties of Bullitt,\nHenry, Jefferson, Oldham, Shelby, Spencer, and Trimble;\n(g) Regional service area seven (7), which shall include the counties of Boone,\nKenton, Campbell, Carroll, Gallatin, Owen, Grant, and Pendleton;\n(h) Regional service area eight (8), which shall include the counties of Bracken,\nMason, Robertson, Fleming, and Lewis;\n(i) Regional service area nine (9), which shall include the counties of Rowan,\nBath, Montgomery, Menifee, and Morgan;\n(j) Regional service area ten (10), which shall include the counties of Greenup,\nBoyd, Carter, Elliott, and Lawrence;\n(k) Regional service area eleven (11), which shall include the counties of\nJohnson, Magoffin, Martin, Floyd, and Pike;\n(l) Regional service area twelve (12), which shall include the counties of Wolfe,\nOwsley, Lee, Breathitt, Leslie, Perry, Knott, and Letcher;\n(m) Regional service area thirteen (13), which shall include the counties of\nJackson, Rockcastle, Laurel, Clay, Knox, Whitley, Bell, and Harlan;\n(n) Regional service area fourteen (14), which shall include the counties of\nTaylor, Adair, Green, Casey, Russe ll, Pulaski, Clinton, Cumberland, Wayne,\nand McCreary; and\n(o) Regional service area fifteen (15), which shall include the counties of\nAnderson, Franklin, Woodford, Mercer, Boyle, Lincoln, Garrard, Jessamine,\nFayette, Scott, Harrison, Bourbon, Nicholas, Cl ark, Madison, Powell, and\nEstill.\n(2) Notwithstanding subsection (1) of this section, any combination of cities or counties\nof over fifty thousand (50,000) population, and upon the consent of the secretary of\nthe cabinet any combination of cities or counti es with less than fifty thousand\n(50,000) population, may establish a regional community services program and\nstaff same with persons specially trained in psychiatry and related fields. Such\nprograms and clinics may be administered by a community board for  mental health\nor individuals with an intellectual disability established pursuant to KRS 210.370 to\n210.460, or by a nonprofit corporation.\n(3) Notwithstanding any provision of law to the contrary and except as provided for in\nsubsections (4) and (5) of this section:\n(a) A regional community services program may provide services outside of its\nregional service area as established in subsection (1) of this section, but when\ndoing so, the regional community services program shall be considered,\nincluding by the cabinet, to be operating as a behavioral health services\norganization and not a regional community services program.\n(b) A regional community services program shall not be required to obtain\nlicensure or any other form of authorization from the cabinet  to operate as a\nbehavioral health services organization outside of its regional service area as\nestablished in subsection (1) of this section.\n(c) When a regional community services program chooses to provide services as\na behavioral health services organization outside of its regional service area as\nestablished in subsection (1) of this section, the regional community services\nprogram shall:\n1. Comply with all administrative regulations related to behavioral health\nservices organizations promulgated by the cabinet; and\n2. Be reimbursed by the Department for Medicaid Services or a managed\ncare organization with whom the department has contracted for the\ndelivery of Medicaid services in accordance with KRS 205.560(8)(b).\n(4) (a) For any services being provi ded by a regional community services program\noutside of its regional service area as established in subsection (1) of this\nsection prior to June 29, 2023, the provisions of subsection (3) of this section\napply on or after January 1, 2025.\n(b) Beginning on June 29, 2023, the provisions of this subsection shall apply to\nany expansion of current out -of-region services, including the provision of\nadditional services in an out -of-region county in which the regional\ncommunity services program is providing service s on June 29, 2023, and any\nexpansion of services into an out -of-region county in which the regional\ncommunity services program is not providing services on June 29, 2023.\n(5) (a) If a regional community services program notifies the secretary in writing t hat\nthe regional community services program is unable to provide a service that is\nincluded in its respective plan and budget for the current fiscal year:\n1. The secretary shall contact the regional community services programs in\nthe regional service areas  contiguous to the region that has notified the\nsecretary to assess their interest in and ability to provide the service that\nthe regional community service program indicated it is unable to\nprovide. If a regional community services program in a contiguous\nregional service area is interested in and able to provide the service, the\nsecretary shall approve it to provide that service in the regional service\narea of the regional community services program that made notice to the\nsecretary; and\n2. If a regional community services program in a contiguous region is not\ninterested in or is unable to provide the service, the secretary shall\ncontact all other regional community services programs to assess their\ninterest in and ability to provide the service that the r egional community\nservices program indicated it is unable to provide. If another regional\ncommunity services program in a noncontiguous regional service area is\ninterested in and able to provide the service, the secretary shall approve\nit to provide that s ervice in the regional service area of the regional\ncommunity services program that made notice to the secretary.\n(b) If the secretary receives joint notification from a regional community services\nprogram assigned to serve a specific county pursuant to su bsection (1) of this\nsection and a regional community services program whose region as\nestablished in subsection (1) of this section is contiguous to the region in\nwhich the county lies requesting that the regional community services\nprogram from the conti guous region be permitted to continue to provide an\narray of services that it was providing in the county in question on June 29,\n2023, the secretary shall approve and recognize the collaborative request.\n(c) If a regional community services program is app roved by the secretary\npursuant to this subsection to provide services outside of its regional service\narea as established in subsection (1) of this section, the regional community\nservices program shall be considered, including by the cabinet, to be operating\nas a regional community services program and shall be reimbursed by the\nDepartment for Medicaid Services or a managed care organization with whom\nthe department has contracted for the delivery of Medicaid services\naccordingly.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54183","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:11Z","sha256":"0a1cafff63bd619180b8d62f9a585101d3653b3cad1ab78fd1c4b60b6767d025","source_id":"us-ky","stale":false,"prev":"us-ky/krs-210.368","next":"us-ky/krs-210.380"},"notice":"GroundRules: Original legal text.
