{"data":{"id":"us-ky/krs-210.570","jurisdiction":"us-ky","citation":"KRS 210.570","heading":"Legislative findings on review and evaluation of current system of services","body":"and supports for persons with an intellectual disability and other\ndevelopmental disabilities -- Construction of KRS 210.570 to 210.577.\nThe General Assembly of the Commonwealth of Kentucky hereby finds and declares that:\n(1) Assistance and support to citizens of the Commonwealth with an intellectual\ndisability and other developmental disabilities are necessary and appropriate roles of\nstate government;\n(2) The current system of services and supports to persons with an intellectual disability\nand other developmental disabilities suffers from a lack of program coordination,\nfunding, controls on quality of care, and review and evaluation;\n(3) As part of the review and evaluation, it is necessary to require:\n(a) Identification, development, and provision of services and supports for\npersons with an intellectual disability and other developmental disabilities\nusing available institutional care as appropriate and integrated with\ncommunity-based services designed to be inclusive, responsive to individual\nneeds, and protective of the individual's legal rights to equal opportunity;\n(b) Review of current funding mechanisms to determine the best method to\nestablish an array of community -based comprehensive services using facility -\nbased outpatient services and supports that are available through public and\nprivate sectors, including nonprofit and for -profit service providers, that will\nallow persons with an intellectual disability and other  developmental\ndisabilities the opportunity to participate in community life. The review shall\ninclude consideration of the availability of residential alternatives,\nemployment opportunities, and opportunities for participation in community -\nbased social and recreational activities; and\n(c) Development of funding strategies to promote appropriate use of community -\nbased services and supports that provide:\n1. Flexibility for persons with an intellectual disability and other\ndevelopmental disabilities;\n2. Distribution of available funds among all interested service providers,\nincluding nonprofit and for -profit service providers, based on the needs\nof the person with an intellectual disability and other developmental\ndisabilities; and\n3. Efficiency and accountability to the general public;\n(4) KRS 210.570 to 210.577 shall be construed to protect and to promote the\ncontinuing development and maintenance of the physical, mental, and social skills\nof persons with an intellectual disability and other developmental disabilities; and\n(5) KRS 210.570 to 210.577 shall not be construed:\n(a) To alter any requirements or responsibilities that are mandated by any state or\nfederal law;\n(b) To relieve any organizational unit or administrative body of its duties under\nstate or federal law; or\n(c) To transfer among state organizations or administrative bodies any\nresponsibilities, powers, or duties that are mandated by state or federal law.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40820","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:11Z","sha256":"1928267bcc339f934de446814f31aa12ec3ebc0e170fa1ddc07b8263c456762f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-210.550","next":"us-ky/krs-210.575"},"notice":"GroundRules: Original legal text.
