{"data":{"id":"us-ky/krs-210.575","jurisdiction":"us-ky","citation":"KRS 210.575","heading":"Kentucky Commission on Services and Supports for Individuals with an","body":"Intellectual Disability and Other Developmental Disabilities -- Membership --\nChair -- Compensation.\n(1) There is created the Kentucky Commission on Services and Supports fo r\nIndividuals with an Intellectual Disability and Other Developmental Disabilities.\nThe commission shall consist of:\n(a) The secretary or designee of the Cabinet for Health and Family Services;\n(b) The commissioner or designee of the Department for Behavio ral Health,\nDevelopmental and Intellectual Disabilities;\n(c) The commissioner or designee of the Department for Medicaid Services;\n(d) The commissioner or designee of the Department of Education;\n(e) The executive director of the Office of Vocational Rehabilitation;\n(f) The director of the University Affiliated Program at the Interdisciplinary\nHuman Development Institute of the University of Kentucky;\n(g) The director of the Kentucky Council on Developmental Disabilities;\n(h) Two (2) members of the House of  Representatives, appointed by the Speaker\nof the House;\n(i) Two (2) members of the Senate, appointed by the Senate President; and\n(j) Public members, appointed by the Governor as follows:\n1. One (1) member representing families of a child with an intellec tual or\nother developmental disability residing in the home of the family\nmember;\n2. One (1) member representing families of an adult with an intellectual or\nother developmental disability residing in the home of the family\nmember;\n3. One (1) member representing families of an adult with an intellectual or\nother developmental disability residing in a community-based setting;\n4. One (1) member representing families of an individual with an\nintellectual or other developmental disability r esiding in an institutional\nresidential facility that provides services to individuals with intellectual\ndisabilities;\n5. Three (3) persons with intellectual or other developmental disabilities;\n6. Two (2) business leaders;\n7. Two (2) providers of intellec tual or other developmental disability\nservices;\n8. One (1) provider of intellectual or other developmental disability\nservices that is a regional community program for mental health or\nindividuals with an intellectual disability established pursuant to KR S\n210.370; and\n9. One (1) representative of a statewide advocacy organization providing\neducation and outreach on topics associated with intellectual and other\ndevelopmental disabilities.\nThe thirteen (13) appointments made under this paragraph shall be c hosen to reflect\nrepresentation from each of Kentucky's six (6) congressional districts.\n(2) The secretary of the Cabinet for Health and Family Services may serve as chair of\nthe commission or the secretary may appoint his or her designee, the commissioner\nof the Department for Behavioral Health, Developmental and Intellectual\nDisabilities, or the commissioner's designee to serve as chair.\n(3) Members defined in subsection (1)(a) to (i) of this section shall serve during their\nterms of office. All public me mbers appointed by the Governor shall serve a four\n(4) year term and may be reappointed for one (1) additional four (4) year term.\n(4) The members appointed by the Governor shall serve until their successors are\nappointed and qualified.\n(5) Members appoint ed by the Governor to fill a vacated position shall serve the\nremainder of that position's term and may be reappointed for a four (4) year term.\n(6) Members described in subsection (1)(h) and (i) of this section who fail to attend\nfifty percent (50%) of co mmission meetings in a fiscal year may be recommended\nto the Speaker of the House or the Senate President for replacement with new\nmembers.\n(7) Members appointed under subsection (1)(j) of this section shall provide advance\nnotice, on a meeting -by-meeting basis, to the person designated by the commission\nchair if the member will be sending a representative.\n(8) Members appointed under subsection (1)(j) of this section who fail to attend fifty\npercent (50%) of the commission meetings in a fiscal year may be recommended to\nthe Governor for replacement with a new member.\n(9) Members appointed under subsection (1)(j) of this section who send representatives\nfor greater than fifty percent (50%) of the commission meetings in a fiscal year may\nbe recommended to the Governor for replacement with a new member.\n(10) All public members of the commission shall receive twenty -five dollars ($25) per\nday for attending each regularly scheduled meeting or any special meeting called by\nthe chair.
