{"data":{"id":"us-ky/krs-210.720","jurisdiction":"us-ky","citation":"KRS 210.720","heading":"Charge for board of patients -- Method of establishing.","body":"(1) Every patient admitted to a facility operated or utilized by the cabinet, except\nprisoners transferred pursuant to KRS 202A.201, shall be charged for their board,\nmaintenance and treatment pursuant to this section and the cabinet may sue in the\nFranklin Ci rcuit Court or Franklin District Court to recover from the patient or\nperson responsible for the patient for liability as established by this section.\n(2) The secretary shall fix the patient cost per day for board, maintenance and treatment\nfor each facili ty operated by the cabinet at frequent intervals which shall be the\nuniform charge for all persons receiving such services.\n(3) The liability of any patient, or person responsible for the patient, for payment of the\ncharge for board, maintenance and treatm ent shall be based upon ability to pay by\nascertaining the entire financial resources available to the patient, or to the person\nresponsible for the patient, and shall include, but shall not be limited to: insurance,\nall third party coverage including Medi care and Medicaid and other governmental\nprograms, cash, stocks, bonds, and all other property owned by the patient or\ncontrolled by the person responsible for the patient. The secretary shall establish a\nreasonable means test for determining payment liabi lity of patients and persons\nresponsible for patients. In no event shall liability be in excess of the cost per\npatient per day established by the secretary.\n(4) Nothing in KRS 210.710 to 210.760 shall be construed to limit any liability of\ninsurance companies or other third party payors including Medicare and Medicaid\nand other governmental programs.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8313","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:11Z","sha256":"d66fd675164a25e2273bdc91eac7cabebc6917ca8ed598aa5ac77320972fc287","source_id":"us-ky","stale":false,"prev":"us-ky/krs-210.710","next":"us-ky/krs-210.730"},"notice":"GroundRules: Original legal text.
