{"data":{"id":"us-ky/krs-210.770","jurisdiction":"us-ky","citation":"KRS 210.770","heading":"Definitions for KRS 210.770 to 210.795.","body":"As used in KRS 210.770 to 210.795, unless the context otherwise requires:\n(1) \"Mental impairment\" includes an intellectual disability, organic brain syndrome,\nemotional or mental illness, and specific learning disabilities;\n(2) \"Person with a disability\" means someone with a physical or mental impairment and\nincludes individuals who have a record or history of an impairment, or are regarded\nas having a physical or mental impairment that substantially limits one (1) or more\nmajor life activities;\n(3) \"Physical impairment\" means any physiological disorder or corrective, cosmetic\ndisfigurement, or an anatomical loss affecting one (1) or more of the following body\nsystems: neurological, musculo-skeletal, special sense organs, respiratory including\nspeech organs,  cardiovascular, reproductive, digestive, genito -urinary, hemic and\nlymphatic, skin, and endocrine;\n(4) \"Substantial limitation of a major life activity\" includes limiting such things as\nwalking, talking, seeing, hearing, caring for oneself, or working;\n(5) \"Hart-Supported Living Program\" means grants which provide a broad category of\nhighly flexible, individualized services which, when combined with natural unpaid\nor other eligible paid supports, provide the necessary assistance to do the following:\n(a) Provide the support necessary to enable a person who is disabled to live in a\nhome of the person's choice which is typical of those living arrangements in\nwhich persons without disabilities reside;\n(b) Encourage the individual's integrated participation in t he community with\npersons who are members of the general citizenry;\n(c) Promote the individual's rights and autonomy;\n(d) Enhance the individual's skills and competences in living in the community;\nand\n(e) Enable the individual's acceptance in the communit y by promoting home\nownership or leasing arrangements in the name of the individual or the\nindividual's family or guardian;\n(6) \"Hart-Supported Living Program\" does not include any services that support the\nfollowing arrangements:\n(a) Segregated living mod els such as any housing situation which physically or\nsocially isolates people with disabilities from general citizens of the\ncommunity;\n(b) Segregated programs or activities which physically or socially isolate people\nwith disabilities from general citizens of the community;\n(c) Congregate living models such as any housing situation which groups\nindividuals with disabilities as an enclave within an integrated setting;\n(d) Any model where the individual, as an adult, does not have maximum control\nof the home environment commensurate with the individual's disabilities; and\n(e) Any single living unit where more than three (3) people with disabilities live;\n(7) \"Hart-Supported Living Council\" means a supported living council appointed by the\nGovernor and recognized by the secretary; and\n(8) \"Hart-supported living services\" include but are not limited to:\n(a) Hart-supported living community resource developers;\n(b) Homemaker services;\n(c) Personal care services;\n(d) In-home training and home management assistance;\n(e) Start-up grants;\n(f) Transportation;\n(g) Home modifications;\n(h) Adaptive and therapeutic equipment; and\n(i) Facilitation by an indepen dent and trained facilitator to develop and\nimplement individualized life planning.","path":["KRS Chapter 210"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44641","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:11Z","sha256":"91a165eec3593c78f3155627ec11d5cdf1683a03d07069cb680845bea1ec316c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-210.760","next":"us-ky/krs-210.775"},"notice":"GroundRules: Original legal text.
