{"data":{"id":"us-ky/krs-210.795","jurisdiction":"us-ky","citation":"KRS 210.795","heading":"Standards for Hart -Supported Living Council living arrangements --","body":"Administrative regulations.\n(1) The cabinet, in cooperation with the Hart -Supported Living Council, shall establish\nstandards for the administration of the Hart-Supported Living Program. The purpose\nof these standards is to ensure that a person with a disability receives supported\nliving services in a manner that empowers the person to exercise choice and\nenhances the quality of that person's life. These standards shall promote the\nfollowing:\n(a) Choice over how, when, and by whom supports are provided and over where\nand with whom a person with a disability lives;\n(b) Responsibility of the person with a disability and his or her representative for\nmanaging grants and the provision of supports under the grant;\n(c) Freedom to live a meaningful life and to participate in activities in the\ncommunity with members of the general citizenry;\n(d) Enhancement of health and safety;\n(e) Flexibility of services that change as the person's needs chan ge without the\nindividual having to move elsewhere for services;\n(f) Use of generic options and natural supports;\n(g) Well-planned and proactive opportunities to determine the kinds and amounts\nof support desired, with the meaningful participation of the i ndividual, the\nindividual's family or guardian where appropriate, friends, and professionals;\nand\n(h) Home ownership or leasing with the home belonging to the person with a\ndisability, that person's family, or to a landlord to whom rent is paid.\n(2) The in dividual supported living plan shall be developed by the person with a\ndisability and that person's family or guardian where appropriate, and, as\nappropriate, the proposed or current provider.\n(3) The cabinet, in concert with the Hart -Supported Living Coun cil, shall promulgate\nadministrative regulations under KRS Chapter 13A, if necessary, to establish the\nmethods of awarding Hart -Supported Living Program grants for individual\nsupported living plans and monitoring the quality of service delivery, and to provide\nfor administrative appeal of decisions.
