{"data":{"id":"us-ky/krs-211.192","jurisdiction":"us-ky","citation":"KRS 211.192","heading":"Information to be provided concerning Down syndrome and spina bifida --","body":"By whom -- When.\n(1) For the purposes of this section:\n(a) \"Down syndrome\" means a chromosomal condition caused by cell division\nthat results in the presence of an extra whole or par tial copy of chromosome\n21; and\n(b) \"Spina bifida\" means a neural tube defect, the most common of which is the\nopen neural tube defect myelomeningocele.\n(2) A health facility as defined in KRS 216B.015(13), physician, health care provider,\nnurse midwife, o r genetic counselor who renders prenatal care, postnatal care, or\ngenetic counseling, upon receipt of a positive test result from a test for Down\nsyndrome or spina bifida, shall provide the expectant or new parent with\ninformation provided by the Cabinet f or Health and Family Services under\nsubsection (3) of this section.\n(3) The Cabinet for Health and Family Services shall make available to any person who\nrenders prenatal care, postnatal care, or genetic counseling to parents who receive a\nprenatal or postnatal diagnosis of Down syndrome or spina bifida and to any person\nwho has received a positive test result from a test for Down syndrome or spina\nbifida the following:\n(a) Up-to-date, evidence -based, written information about Down syndrome or\nspina bifida that has been reviewed by medical experts and Down syndrome or\nspina bifida organizations and includes information on physical,\ndevelopmental, educational, and psychosocial outcomes, life expectancy,\nclinical course, intellectual and functional development , and treatment\noptions; and\n(b) Contact information regarding support programs and services for expectant\nand new parents of children with Down syndrome or spina bifida, including\ninformation hotlines specific to Down syndrome or spina bifida, resource\ncenters or clearinghouses, national and local Down syndrome or spina bifida\norganizations such as Down Syndrome of Louisville, Down Syndrome\nAssociation of Central Kentucky, Down Syndrome Association of South\nCentral Kentucky, Green River Area Down Syndrome Association, Down\nSyndrome Association of Greater Cincinnati Serving Northern Kentucky,\nCouncil on Developmental Disabilities, the Spina Bifida Association of\nKentucky, and other education and support programs.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44399","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"afd45c41233ff1a779c5a8c0416ce84dfaa3b8e165f771dc2c111cd1814878e4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.190","next":"us-ky/krs-211.195"},"notice":"GroundRules: Original legal text.
