{"data":{"id":"us-ky/krs-211.203","jurisdiction":"us-ky","citation":"KRS 211.203","heading":"Definitions of \"Class A\" and \"Class B\" -- Requirement of lifeguards at","body":"Class A and Class B pools -- Alternative lifeguard staffing plans -- Exemptions\n-- Administrative regulations.\n(1) As used in this section:\n(a) \"Class A\" means any pool or bat hing facility intended for or used by the\ngeneral public for recreational use; and\n(b) \"Class B\" means any pool not open to the general public, but open to limited\ngroups and their invited guests, including but not limited to:\n1. Health or athletic clubs;\n2. Country clubs; or\n3. Residential communities.\n(2) (a) Lifeguards shall be required at all Class A and Class B pools if the pool\nfacility meets at least one (1) of the following criteria:\n1. Allows persons seventeen (17) years of age or younger to enter the pool\nfacility enclosure without a responsible adult eighteen (18) years or\nolder;\n2. Contains features such as induced waves or slides that are available for\nuse; or\n3. Contains an entry into the pool f rom a height above the deck from a\ndiving board, platform, climbing wall or other similar feature, that is\navailable for use.\n(b) If a Class A or Class B pool meets any of the criteria in paragraph (a) of this\nsubsection, it shall provide one (1) lifeguard  for each one (1) to one hundred\n(100) bathers.\n(3) Lifeguards shall be required at all Class A pools that do not meet any of the criteria\nin subsection (2)(a) of this section if the pool facility has:\n(a) Two thousand (2,000) square feet or greater of wat er surface area, in which\ncase it shall provide one (1) lifeguard for each two thousand (2,000) square\nfeet or major fraction more than half thereof; or\n(b) One hundred (100) or more bathers, in which case it shall provide one (1)\nlifeguard for each one hundred (100) or more bathers.\n(4) At a pool where the use is intended for aquatic events, swimming practice, or\nswimming competition, the swimming coach or instructor that provides instruction\nduring the program may count as a lifeguard, provided the coach or instructor can\nsupervise the entire group.\n(5) Notwithstanding subsections (2) and (3) of this section, the Cabinet for Health and\nFamily Services may allow Class A and Class B pools to submit an alternative\nlifeguard staffing plan that has been certifi ed by a third -party compliance specialist\nthat is recognized by the Cabinet for Health and Family Services.\n(6) All Class A and Class B pools shall be equipped with an emergency shut -off switch\nto disconnect power to pool recirculation, chemical feed, and electrical devices\nengaged with the water circulation system, which is located at a place quickly\naccessible to lifeguards and other pool staff, but secure from the public.\n(7) Any pool located on the same plat as a single -family residence and not used in\nconnection with a home occupation or business shall be exempted from the\nprovisions of this section.\n(8) The Cabinet for Health and Family Services shall promulgate administrative\nregulations in accordance with KRS Chapter 13A to implement this section.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54573","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"26776840e9dc540ab2c2c3bccf3667d6d088f8729e67ae6cf4ae986d4bc8d8d2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.200","next":"us-ky/krs-211.205"},"notice":"GroundRules: Original legal text.
