{"data":{"id":"us-ky/krs-211.285","jurisdiction":"us-ky","citation":"KRS 211.285","heading":"Alcohol wellness and responsibility education fund.","body":"(1) There is hereby created the alcohol wellness and responsibility education fund,\nwhich shall provide moneys on a matching basis for educational information and\nmaterials that deter or eliminate underage drinking. The fund shall consist of\nmoneys generated f rom one percent (1%) of the excise tax collected from the sale\nand distribution of malt beverages under KRS 243.720, one percent (1%) of the\nwholesale tax collected from distributors of malt beverages and microbreweries\nunder KRS 243.884, and all proceeds from public auctions conducted by the\nAlcoholic Beverage Control Board under KRS 241.060 and 243.540.\n(2) The alcohol wellness and responsibility education fund shall be established in the\nState Treasury as a trust and agency account under KRS 45.253. Mone ys in the\naccount shall be distributed by the State Treasurer to the Alcohol Wellness and\nResponsibility Education Corporation, a nonprofit organization that is organized\nunder the laws of this state, upon the authorization of the secretary of the Public\nProtection Cabinet. The moneys shall be awarded to the corporation solely to fund\neducational programs to deter or eliminate underage drinking and promote alcohol\nresponsibility measures.\n(3) The secretary of the Public Protection Cabinet shall authorize th at moneys from the\nfund be disbursed to the corporation upon the secretary's receipt of a certification\nfrom the corporation showing the moneys the corporation has received from malt\nbeverage distributors, microbreweries, auctions, and other private source s since the\nlast certification. The moneys disbursed from the fund shall be equal to the\ncontributions that the corporation has received from its members and other private\nsources during that period. The moneys in the fund shall be disbursed in accordance\nwith a schedule established by the secretary, and shall be disbursed until the\nmoneys in the fund are exhausted or until the moneys in the fund lapse in\naccordance with subsection (4) of this section, whichever comes first.\n(4) Moneys that are credited to the fund and not issued to the corporation shall lapse at\nthe end of the fiscal year and shall be returned to the general fund.\n(5) As a condition of receiving the governmental funds, the corporation's board of\ndirectors shall include the following among its directors:\n(a) All duly elected statewide constitutional officers or designees;\n(b) The President of the Senate or designee, who shall serve as a nonvoting\nmember;\n(c) The Speaker of the House or designee, who shall serve as a nonvoting\nmember;\n(d) The secretary of the Public Protection Cabinet or designee;\n(e) The commissioner of the Department of Alcoholic Beverage Control or\ndesignee;\n(f) A representative of the malt beverage industry submitted by the Kentucky\nBeer Wholesalers' Association;\n(g) A representative of the malt beverage industry submitted by the Kentucky\nMalt Beverage Council; and\n(h) A representative of the distilled spirits in dustry submitted by the Kentucky\nDistillers' Association.\n(6) All expenditures of moneys from the fund shall be approved by a majority of those\npersons set out in subsection (5)(a) and (d) to (h) of this section. If the moneys from\nthe fund are not expende d in their entirety, any moneys that remain unused by the\ncorporation at the end of the fiscal year shall be returned to the general fund.\n(7) Any moneys from the fund that are not expended shall be returned to the general\nfund upon the dissolution of the corporation.\n(8) The Alcohol Wellness and Responsibility Education Corporation may accept\napplications for grants by Kentucky high schools, colleges and universities, and\nother entities that promote alcohol responsibility, and the board of directors shall\ndevelop criteria for the awarding of any funds by application.\n(9) Any high school in the Commonwealth of Kentucky that was registered with the\nDepartment of Education as of July 1, 2024, may make an application to the\nAlcohol Wellness and Responsibility E ducation Corporation by February 28 of\neach year and shall be granted a minimum of one thousand dollars ($1,000)\nannually from the funds contributed by the alcohol wellness and responsibility\neducation fund for the single purpose of supporting \"Project Graduation\" events.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54487","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"226fa70982705b44b821d4d3c97a1321ca79ce67e2e82c07e95bd49b5a48517e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.280","next":"us-ky/krs-211.287"},"notice":"GroundRules: Original legal text.
