{"data":{"id":"us-ky/krs-211.332","jurisdiction":"us-ky","citation":"KRS 211.332","heading":"Definitions for KRS 211.332 to 211.338.","body":"As used in KRS 211.332 to 211.338, unless context otherwise requires:\n(1) \"Cabinet\" means the Cabinet for Health and Family Services;\n(2) \"Health care service\" means health care procedures, treatments, or services rendered\nby a provider within the scope of  practice for which the provider is licensed or\ncertified and includes physical and behavioral health care;\n(3) \"Professional licensure board\" means a licensure board established in Kentucky for\nthe purpose of regulating and overseeing the practice of heal th care providers,\nincluding but not limited to:\n(a) Board of Physical Therapy as established in KRS 327.030;\n(b) Kentucky Applied Behavior Analysis Licensing Board as established in KRS\n319C.030;\n(c) Kentucky Board of Alcohol and Drug Counselors establish ed by KRS\n309.081;\n(d) Kentucky State Board of Chiropractic Examiners established by KRS\n312.025;\n(e) Kentucky Board of Dentistry established by KRS 313.020;\n(f) Kentucky Board of Emergency Medical Services established by KRS\n311A.015;\n(g) Kentucky Board of Examiners of Psychology established by KRS 319.020;\n(h) Kentucky Board of Licensed Diabetes Educators established by KRS 309.329;\n(i) Kentucky Board of Licensed Professional Counselors established by KRS\n335.510;\n(j) Kentucky Board of Licensure and Certification for Dietitians and Nutritionists\nestablished by KRS 310.040;\n(k) Kentucky Board of Licensure for Marriage and Family Therapists established\nby KRS 335.310;\n(l) Kentucky Board of Licensure for Occupational Thera py established by KRS\n319A.020;\n(m) Kentucky Board of Licensure for Professional Art Therapists established by\nKRS 309.131;\n(n) State Board of Medical Licensure established by KRS 311.530;\n(o) Kentucky Board of Nursing established by KRS 314.121;\n(p) Kentucky Board of Optometric Examiners established by KRS 320.230;\n(q) Kentucky Board of Pharmacy established by KRS 315.150;\n(r) Kentucky Board of Social Work established by KRS 335.050;\n(s) Kentucky Board of Respiratory Care established by KRS 314A.200; and\n(t) Kentucky Board of Speech-Language Pathology and Audiology established by\nKRS 334A.070;\n(4) \"State agency authorized or required to promulgate administrative regulations\nrelating to telehealth\" means:\n(a) A professional licensure board;\n(b) The Cabinet for Health and Family Services;\n(c) The Department for Medicaid Services within the Cabinet for Health and\nFamily Services; and\n(d) The Department of Insurance within the Public Protection Cabinet; and\n(5) \"Telehealth\" or \"digital health\":\n(a) Means a mode of delivering healthcare services through the use of\ntelecommunication technologies, including but not limited to synchronous and\nasynchronous technology, remote patient monitoring technology, and audio -\nonly encounters, by a health care provider to a patient or to another health care\nprovider at a different location;\n(b) Shall not include:\n1. The delivery of health care services through electronic mail, text, chat,\nor facsimile unless a state agency authorized or required to promulgate\nadministrative regula tions relating to telehealth determines that health\ncare services can be delivered via these modalities in ways that enhance\nrecipient health and well -being and meet all clinical and technology\nguidelines for recipient safety and appropriate delivery of services; or\n2. Basic communication between a health care provider and a patient,\nincluding but not limited to appointment scheduling, appointment\nreminders, voicemails, or any other similar communication intended to\nfacilitate the actual provision of health care services either in -person or\nvia telehealth; and\n(c) Unless waived by the applicable federal authority, shall be delivered over a\nsecure communications connection that complies with the federal Health\nInsurance Portability and Accountability Act of 19 96, 42 U.S.C. secs. 1320d\nto 1320d-9.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51045","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"1b88b069ad03039abcf2b1c76e2a2f9d5228411b00b83f9470b205228f70ecde","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.330","next":"us-ky/krs-211.334"},"notice":"GroundRules: Original legal text.
