{"data":{"id":"us-ky/krs-211.334","jurisdiction":"us-ky","citation":"KRS 211.334","heading":"Establishment of minimum standards and requirements for use of","body":"telehealth -- Administrative regulations -- Study and annual report on impact\nof telehealth on care in state.\n(1) The cabinet, in consultation with the Division of Telehealth Services within the\nOffice of Inspector General as established in KRS 194A.105, shall:\n(a) Provide guidance and direction to providers delivering health care services\nusing telehealth or digital health;\n(b) Promote access to health care services provided v ia telehealth or digital\nhealth;\n(c) Maintain an online telehealth provider directory for consumer use; and\n(d) No later than thirty (30) days after June 29, 2021, promulgate administrative\nregulations in accordance with KRS Chapter 13A to:\n1. Establish a glossary of telehealth terminology to provide standard\ndefinitions for all healthcare providers who deliver health care services\nvia telehealth, all state agencies authorized or required to promulgate\nadministrative regulations relating to telehealth, and all payors;\n2. Establish minimum requirements for the proper use and security of\ntelehealth, including requirements for confidentiality and data integrity,\nprivacy and security, informed consent, privileging and credentialing,\nreimbursement, and technology;\n3. Establish minimum requirements to prevent waste, fraud, and abuse\nrelated to telehealth; and\n4. Maintain the discretion of state agencies authorized or required to\npromulgate administrative regulations relating to telehealth to establish\nrequirements to authorize, prohibit, or otherwise govern the use of\ntelehealth in accordance with the state agencies' respective jurisdictions.\n(2) In order to comply with the deadline for the promulgation of administrative\nregulations established in subsection (1)(d) of this section, the cabinet may\npromulgate emergency administrative regulations in accordance with KRS 13A.190.\n(3) The cabinet, in consultation with the Department for Medicaid Services and any\nmanaged care organization with whom the department contracts  for the delivery of\nMedicaid services, shall study the impact of telehealth on the health care delivery\nsystem in Kentucky and shall submit an annual report to the Legislative Research\nCommission no later than December 1 of each year. This report shall in clude\nanalysis of:\n(a) The economic impact of telehealth on the Medicaid budget, including any\ncosts or savings as a result of decreased transportation expenditures and office\nor emergency room visits;\n(b) The quality of care as a result of telehealth services;\n(c) Reimbursement and delivery of telehealth among all managed care\norganizations with whom the department contracts for the delivery of\nMedicaid services; and\n(d) Any other issues deemed relevant by the cabinet, including any issues or\ninformation deemed relevant by the Division of Telehealth Services pursuant\nto KRS 194A.105(4).","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52617","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"dff640a1292aaecbb212b40b5b6dc5a0d1622daabae968b7eb855387476713a9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.332","next":"us-ky/krs-211.335"},"notice":"GroundRules: Original legal text.
