{"data":{"id":"us-ky/krs-211.357","jurisdiction":"us-ky","citation":"KRS 211.357","heading":"Certification of installers of on-site sewage disposal systems -- Fees.","body":"(1) The cabinet shall establish a program to certify persons as installers of on -site\nsewage disposal systems. A master plumber licensed pursuant to KRS Chapter 318\nor a person who provides written verification from the local health department in\nthe county in which the work was completed that he installed five (5) lateral fields\nand septic tank systems prior to July 13, 1984, and that these installations had been\ninspected by a certified inspector and passed inspection, shall be certified\nautomatically.\n(2) The cabinet shall establish as a part of the certification program referenced in\nsubsection (1) of this section a means of issuing a probationary certification for\ninstallers of on -site sewage disposal systems. This probationary certification shall\nautomatically be converted to a full certification at the time that the holder of the\nprobationary certificate has installed five (5) lateral fields and septic tank systems\nand has provided written verification from the local health department in the county\nin which the work was completed that these installations have been inspected by a\ncertified inspector and passed the inspection. The cabinet shall issue a full\ncertificate to the holder of the probationary certificate no later than sixty (60) days\nafter receipt of verification. In order to be issued a probationary certification,\neligible persons shall certify in writing that they will make installations in\naccordance with requirements set forth by the Cabinet for Health and Family\nServices.\n(3) The cabinet may promulgate administrative regulations to establish a fee that:\n(a) Shall be the total of the operational and administrative costs of the programs\nto the cabinet and to agencies as defined in KRS 211.185;\n(b) Beginning on March 17, 2020, until December 31, 20 20, shall not increase\nmore than twenty-five percent (25%) of the fee amount on March 17, 2020;\n(c) Beginning on or after January 1, 2021, shall not increase more than five\npercent (5%) for each year thereafter; and\n(d) Shall be paid by persons certified a s installers, except master plumbers\nlicensed pursuant to KRS Chapter 318.\n(4) The cabinet may revoke or suspend any certification issued pursuant to this section\nupon proof that the certified person has:\n(a) Knowingly violated the provisions of this chapt er or the regulations of the\ncabinet;\n(b) Practiced fraud or deception in applying for or obtaining a certificate;\n(c) Is incompetent to install on-site sewage disposal systems;\n(d) Permitted the certification to be used directly or indirectly by another to install\non-site sewage disposal systems; or\n(e) Is guilty of other unprofessional or dishonorable conduct of a character likely\nto deceive or defraud the public.\n(5) Upon appeal of any decision to revoke or suspend a certification, an administrative\nhearing shall be conducted in accordance with KRS Chapter 13B.\n(6) Nothing in this section shall be construed to condone the installation of on -site\nsewage disposal systems contrary to specifications for these systems established by\nthe cabinet.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49818","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"11c90a6840e44e04cd77fc151704d7d2008a99573bb109332113ec273714dc32","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.355","next":"us-ky/krs-211.360"},"notice":"GroundRules: Original legal text.
