{"data":{"id":"us-ky/krs-211.360","jurisdiction":"us-ky","citation":"KRS 211.360","heading":"Certification of inspectors.","body":"(1) The cabinet shall establish a program to certify persons as inspectors solely for on -\nsite sewage disposal systems.  Persons eligible for certification shall include\nsanitarians, engineers, soil scientists, and other qualified persons as determined by\nregulation by the cabinet.  In order to be certified by the cabinet, eligible persons\nshall:\n(a) Attend a training session concerning the proper construction and installation\nof on-site sewage disposal systems conducted by the cabinet;\n(b) Indicate sufficient skill and competency necessary for proper inspection of on-\nsite sewage disposal systems by adequate performance on an examination\nprescribed by the cabinet;\n(c) Pay a reasonable fee related to the cost of conducting training and certification\nsessions to be utilized to defray the cost of conducting the sessions; and\n(d) Renew the certificates of competence at reasonable intervals.\n(2) No person shall approve the construction, installation, or alteration of an on -site\nsewage disposal system unless it is in co nformance with the regulations issued by\nthe cabinet.\n(3) The cabinet may revoke or suspend any certification issued pursuant to this section\nupon proof that the certified person has:\n(a) Knowingly violated the provisions of this chapter or the regulations  of the\ncabinet;\n(b) Practiced fraud or deception in applying for or obtaining a certificate;\n(c) Is incompetent to perform inspection services;\n(d) Permitted the certification to be used directly or indirectly by another to obtain\nor perform inspections; or\n(e) Is guilty of such other unprofessional or dishonorable conduct of a character\nlikely to deceive or defraud the public.\n(4) Upon appeal of any decision to revoke or suspend a certification, an administrative\nhearing shall be conducted in accordance with KRS Chapter 13B.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8388","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"e261c31eb0d071aac0621a41ee772d4abf017e686c85b7ff78c74f160ec45599","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.357","next":"us-ky/krs-211.365"},"notice":"GroundRules: Original legal text.
