{"data":{"id":"us-ky/krs-211.472","jurisdiction":"us-ky","citation":"KRS 211.472","heading":"Kentucky Traumatic Brain Injury Trust Fund Board.","body":"(1) The Kentucky Traumatic Brain Injury Trust Fund Board is hereby created for the\npurpose of administering the trust fund. The board shall be composed of nine (9)\nmembers including the secretary of the Cabinet for Health and Family Services or\nthe secretary's designee, the executive director of the Brain Injury Association of\nKentucky or the executive director's designee, the state medical epidemiologist, and\nthe following members, to be appointed by the Governor:\n(a) One (1) member shall be a neurosurgeon;\n(b) One (1) member shall be a neuropsychologist or psychiatrist;\n(c) One (1) member shall be a rehabilitation specialist;\n(d) One (1) member shall be a social worker experienced in working with brain -\ninjured individuals; and\n(e) Two (2) members shall be fami ly members of or individuals with a brain\ninjury.\n(2) Board members shall not be compensated for serving, but shall be reimbursed for\nordinary travel expenses, including meals and lodging incurred in the performance\nof their duties.\n(3) The terms of appointed board members shall be four (4) years, except that the terms\nof initial members shall be staggered to end as follows:\n(a) Two (2) on June 30, 2000;\n(b) Two (2) on June 30, 2001; and\n(c) Two (2) on June 30, 2002.\n(4) At the end of a term, a member shall continue to serve until a successor is appointed\nand qualifies. A member who is appointed after a term has begun shall serve the rest\nof the term and until a successor is appointed and qualifies. A member who serves\ntwo (2) consecutive four (4) year terms  shall not be reappointed for four (4) years\nafter completion of those terms.\n(5) A majority of the full authorized membership shall constitute a quorum.\n(6) The board shall elect, by a majority vote, a director who shall be the presiding\nofficer of the bo ard, preside at all meetings, and coordinate the functions and\nactivities of the board. The director shall be elected or reelected for each calendar\nyear.\n(7) The board may establish  any organizational structure it determines is necessary to\naccomplish its functions and duties, including the hiring of any necessary support\npersonnel. The administrative costs of the board shall be limited to three percent\n(3%) of the proceeds from the trust fund.\n(8) Meetings of the board shall be held at least twice a year but may be held more\nfrequently, as deemed necessary, subject to call by the director or by the request of a\nmajority of the board members.\n(9) The board shall be attached to the cabinet for administrative purposes.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8413","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:12Z","sha256":"e7f13e1f7bca521d960eeb4a4178357a9e4640749948fb26e98e2cc3e54f4efa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.470","next":"us-ky/krs-211.474"},"notice":"GroundRules: Original legal text.
