{"data":{"id":"us-ky/krs-211.575","jurisdiction":"us-ky","citation":"KRS 211.575","heading":"Statewide system for stroke response and treatment.","body":"(1) As used in this section, \"department\" means the Department for Public Health.\n(2) The Department for Public Health shall establish and implement a plan for\nachieving continuous qua lity improvement in the quality of care provided under a\nstatewide system for stroke response and treatment. In implementing the plan, the\ndepartment shall:\n(a) Maintain a statewide stroke database to compile information and statistics on\nstroke care as follows:\n1. The database shall align with the stroke consensus metrics developed\nand approved by the American Heart Association, the American Stroke\nAssociation, the Centers for Disease Control and Prevention, and the\nJoint Commission;\n2. The department shal l utilize the \"Get With The Guidelines -Stroke\"\nquality improvement program maintained by the American Heart\nAssociation and the American Stroke Association or another nationally\nrecognized program that utilizes a data set platform with patient\nconfidentiality standards no less secure than the statewide stroke\ndatabase established in this paragraph; and\n3. Require certified stroke centers as established in KRS 216B.0425 to\nreport to the database each case of stroke seen at the facility. The data\nshall be rep orted in a format consistent with nationally recognized\nguidelines on the treatment of individuals within the state with\nconfirmed cases of stroke;\n(b) To the extent possible, coordinate with national voluntary health organizations\ninvolved in stroke quality improvement to avoid duplication and redundancy;\n(c) Encourage the sharing of information and data among health care providers\non methods to improve the quality of care of stroke patients in the state;\n(d) Facilitate communication about data trends and treatment developments\namong health care professionals involved in the care of individuals with\nstroke;\n(e) Require the application of evidence -based treatment guidelines for the\ntransition of stroke patients upon discharge from a hospital following acute\ntreatment to community -based care provided in a hospital outpatient,\nphysician office, or ambulatory clinic setting; and\n(f) Establish a data oversight process and a plan for achieving continuous quality\nimprovement in the quality of care provided under the statewide system for\nstroke response and treatment, which shall include:\n1. Analysis of the data included in the stroke database;\n2. Identification of potential interventions to improve stroke care in\nspecific geographic regions of the state; and\n3. Recommendations to the department and the Kentucky General\nAssembly for improvement in the delivery of stroke care in the state.\n(3) All data reported under subsection (2)(a) of this section shall be made availabl e to\nthe department and all government agencies or contractors of government agencies\nwhich are responsible for the management and administration of emergency\nmedical services throughout the state.\n(4) By September 1 of each year, the department shall prov ide a report of its data and\nany related findings and recommendations to the Governor and to the Legislative\nResearch Commission for referral to the Interim Joint Committee on Health\nServices. The report also shall be made available on the department's website.\n(5) Nothing in this section shall be construed to require the disclosure of confidential\ninformation or data in violation of the federal Health Insurance Portability and\nAccountability Act of 1996.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55581","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:13Z","sha256":"e5e4cdcd36bbd589c65bc71b70bff667121a76cd9a211ed2ce2075902fae3d78","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.570","next":"us-ky/krs-211.576"},"notice":"GroundRules: Original legal text.
