{"data":{"id":"us-ky/krs-211.576","jurisdiction":"us-ky","citation":"KRS 211.576","heading":"Kentucky Rare Disease Advisory Council -- Administration by eligible","body":"entity -- Chair, vice chair, members -- Procedures -- Grants.\n(1) The Kentucky Rare Disease Advisory Council is hereby established to advise the\nGeneral Assembly and state dep artments, agencies, commissions, authorities, and\nprivate institutions that provide services for individuals diagnosed with a rare\ndisease.\n(2) In order to reduce the administrative burden on state agencies, the council\nauthorized under KRS 211.576 to 211. 578 shall be administered by an existing\neligible entity operating within the state defined in subsection (3) of this section.\n(3) An eligible entity shall be a nonprofit organization as defined by 26 U.S.C. sec. 501\nthat operates within Kentucky and has e xperience working in the field of rare\ndiseases.\n(4) The Governor or his or her designee shall appoint a chair and vice chair to the\nadvisory council to serve for an initial term of two (2) years.\n(5) Upon their initial appointment, the chair and vice chai r of the council shall appoint\nother members of the council.\n(6) Upon their initial appointment, the chair and vice chair of the council shall develop\nand submit to the Governor and the General Assembly a written description of the\nintended mission of the council, including any state agencies and legislative\ncommittees it intends to advise.\n(7) After the initial appointments, the Kentucky Rare Disease Advisory Council shall\ndetermine its procedures governing membership and participation, with the\nfollowing exceptions:\n(a) The total council membership shall not exceed twenty (20) members;\n(b) All future appointed members to the council shall be approved by a majority\nvote of existing members;\n(c) All existing and future members of the council, including the c hair and vice\nchair, shall serve terms of two (2) years, beginning on the day of the\nGovernor's appointment, shall be eligible to succeed themselves, and shall\nserve until their successors are appointed; and\n(d) Members of the council shall serve until rep laced. A majority of the council\nmembers shall constitute a quorum for the purposes of conducting business.\n(8) After members are appointed to the council, the council shall apply for, and accept,\nany grant of money from the federal government, private fou ndations, or other\nsources that may be available for programs related to rare diseases.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48645","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:13Z","sha256":"8b9a01a2636a117751b00d87e7403f5a32f41a1636777970240da137e0ecec90","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.575","next":"us-ky/krs-211.577"},"notice":"GroundRules: Original legal text.
