{"data":{"id":"us-ky/krs-211.645","jurisdiction":"us-ky","citation":"KRS 211.645","heading":"Definitions for KRS 211.647 and 216.2970.","body":"As used in KRS 211.647 and 216.2970, unless the context requires otherwise:\n(1) \"Cabinet\" means the Cabinet for Health and Family Services;\n(2) \"Office\" means the Office for Children with Special Health Care Needs;\n(3) \"Permanent childhood hearing loss\" means a hearing deficit identified in infancy or childhood which prevents the acquisition of speech and language through normal channels;\n(4) \"Auditory screening report\" means a written evaluation of an auditory screening as required under KRS 216.2970; and\n(5) \"Infant at high risk for late onset, progressive hearing loss, or both\" means a child at birth who is at a higher risk than normal of becoming deaf or hard of hearing or having progressively worsening hearing due to one (1) or more of the following factors:\n(a) Family history of a congenital hearing loss;\n(b) Rubella or virus during pregnancy;\n(c) Neonatal intensive care of more than five (5) days;\n(d) Below-normal birth weight;\n(e) Neonatal intensive care, regardless of the number of days, for any of t he following conditions:\n1. Extracorporeal membrane oxygenation (ECMO);\n2. Assisted ventilation;\n3. Exposure to ototoxic medications, including but not limited to gentramycin and tobramycin, or loop diuretics, including but not limited to furosemide;\n4. Hyperbilirubinemia that requires 1n exchange transfusion;\n5. Syndromes associated with hearing loss and progressive or late onset hearing loss, including but not limited to neurofibromatosis, osteopetrosis, and Usher, Waardenburg, Alport, Pendred, and Jervell and Lange-Nielson Syndromes;\n6. Congenital ear, nose, or throat anomalies, including but not limited to those involving the pinna, ear canal, ear tags, ear pits, and temporal bone; or\n7. Culture-positive postnatal infections associated with sensorineur al hearing loss, including but not limited to confirmed bacterial and viral meningitis;\n(f) An auditory screening indicating a hearing loss; or\n(g) Any other factor identified by the American Medical Association the American Academy of Pediatrics, or the A merican Academy of Otolaryngology as a cause of late onset or progressive hearing loss.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8449","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:13Z","sha256":"0f9ea68d99e1b700d03afb03b4605c463792ec1cd99641b07a36b2694c43e737","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.640","next":"us-ky/krs-211.647"},"notice":"GroundRules: Original legal text.
