{"data":{"id":"us-ky/krs-211.684","jurisdiction":"us-ky","citation":"KRS 211.684","heading":"Authorization to establish state child fatality review team -- Establishment","body":"of state maternal fatality review team -- Annual report on child and maternal\nfatalities to include demographics of race, ethnicity, and geography -- Privilege\nin civil actions.\n(1) For the purposes of KRS Chapter 211:\n(a) \"Child fatality\" means the death of a person under the age of eighteen (18)\nyears; and\n(b) \"Maternal fatality\" means the death of a woman during pregnancy and within\none (1) year of the end of the pregnancy.\n(2) The Department for Public Health may establish a state child fatality review team.\nThe state child fatality review team may include representatives of public health,\nsocial services, law enforcement agencies with investigation responsibil ities for\nchild fatalities, the offices of Commonwealth's and county attorneys, coroners,\nhealth-care providers, and other agencies or professions deemed appropriate by the\ncommissioner of the department.\n(3) If a state child fatality review team is create d, the duties of the state team may\ninclude but not be limited to the following:\n(a) Develop and distribute a model protocol for local child fatality response teams\nfor the investigation of child fatalities;\n(b) Facilitate the development of local child fa tality response teams, as permitted\nunder KRS 211.686, including but not limited to providing joint training\nopportunities and, upon request, providing technical assistance;\n(c) Review and approve local protocols prepared and submitted by local teams;\n(d) Receive data and information on child fatalities and analyze the information\nto identify trends, patterns, and risk factors;\n(e) Evaluate the effectiveness of prevention and intervention strategies adopted;\n(f) Recommend changes in state programs, legislation, administrative\nregulations, policies, budgets, and treatment and service standards which may\nfacilitate strategies for prevention and reduce the number of child fatalities;\nand\n(g) Cooperate, as appropriate , with the external child fatality and near fatality\nreview panel established by KRS 620.055 upon request.\n(4) The department shall establish a state maternal fatality review team. The state\nmaternal fatality review team may include representatives of publ ic health, social\nservices, law enforcement, coroners, health -care providers, and other agencies or\nprofessions deemed appropriate by the commissioner of the department.\n(5) The duties of the state maternal fatality review team may include but not be limit ed\nto the following:\n(a) Receive data and information on maternal fatalities and analyze the\ninformation to identify trends, patterns, and risk factors;\n(b) Evaluate the effectiveness of prevention and intervention strategies adopted;\nand\n(c) Recommend cha nges in state programs, legislation, administrative\nregulations, policies, budgets, and treatment and service standards which may\nfacilitate strategies for prevention and reduce the number of maternal\nfatalities.\n(6) The department shall prepare an annual report to be submitted no later than\nNovember 1 of each year to the Governor, the Legislative Research Commission\nfor referral to the Interim Joint Committee on Families and Children and the Interim\nJoint Committee on Health Services, the Chief Justice of the Kentucky Supreme\nCourt, and to be made available to the citizens of the Commonwealth. The report\nshall include a statistical analysis, including but not limited to Medicaid, Kentucky\nChildren's Health Insurance Program, or other health benefit coverage , race,\nethnicity, and geography, of the incidence and causes of child and maternal\nfatalities in the Commonwealth during the past fiscal year and recommendations for\naction. The report shall not include any information which would identify specific\nchild and maternal fatality cases. Separate reports may be submitted for the state\nchild fatality review team and the state maternal fatality review team.\n(7) The proceedings, records, opinions, and deliberations of the state child fatality\nreview team and of th e state maternal fatality review team shall be privileged and\nshall not be subject to discovery, subpoena, or introduction into evidence in any\ncivil action in any manner that would directly or indirectly identify specific persons\nor cases reviewed by the state child fatality review team or the state maternal\nfatality review team. Nothing in this subsection shall be construed to restrict or limit\nthe right to discover or use in any civil action any evidence that is discoverable\nindependent of the proceeding s of the state child fatality review team or the state\nmaternal fatality review team.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55578","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:13Z","sha256":"bf90dd1229a16c8cdc2735400781512ee70a18cac291892aaeb96c9749f8b43c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.682","next":"us-ky/krs-211.686"},"notice":"GroundRules: Original legal text.
