{"data":{"id":"us-ky/krs-211.760","jurisdiction":"us-ky","citation":"KRS 211.760","heading":"Tattooing and body piercing of humans by nonmedical personnel for","body":"remuneration -- Registration -- Administrative regulations -- Compliance\nchecks -- Hearings.\n(1) As used in this section:\n(a) \"Body piercing\" means the act of penetrating the skin or body part of a human\nbeing to make a hole, mark, or scar;\n(b) \"Facility\" means the place of business where tattooing, body piercing, or both\nare conducted; and\n(c) \"Tattooing\" means the act of producing scars on a human being or the act of\ninserting pigment under the surface of the skin of a human being, by pricking\nwith a needle or otherwise, to produce indelible marks or figures visible\nthrough the skin, including the application of permanent makeup.\n(2) No person shall engage in, offer to engage in,  or carry on any business of tattooing,\nbody piercing, or both of humans by nonmedical personnel for remuneration within\nthe Commonwealth of Kentucky without first registering with the local health\ndepartment in the district or county in which the person i s to perform tattooing,\nbody piercing, or both. Registrations shall be valid for one (1) year. Applicants for\nregistration shall pay a fee that shall not exceed administrative costs of the program\nto the cabinet, to the local or district health department.\n(3) The Cabinet for Health and Family Services shall promulgate administrative\nregulations relating to:\n(a) Health and cleanliness of places of business in which tattooing, body piercing,\nor both are conducted;\n(b) Sterilization of tattooing and body piercing apparatus;\n(c) Procedures to prevent the spread of disease or infection during or relating to\ntattooing and body piercing procedures;\n(d) Procedures to prevent any tattooing or body piercing of minors without the\nwritten notarized consent of a custodial parent or legal guardian; and\n(e) Such other administrative regulations as may be necessary to protect public\nhealth or properly administer the program requirements of this section,\nincluding application and licensing fees.\n(4) Representatives of the ca binet or local or district health departments may visit a\nfacility at any time during business hours to ensure compliance with the\nrequirements of this section.
