{"data":{"id":"us-ky/krs-211.852","jurisdiction":"us-ky","citation":"KRS 211.852","heading":"Prerequisites to approval of nuclear waste disposal facility -- Procedure --","body":"Exception.\n(1) The location of a nuclear waste disposal facility in the Commonwealth of Kentucky\nshall require prior approval by a majority of the members of the Kentucky Hou se of\nRepresentatives, a majority of the members of the Kentucky Senate, and the\napproval of the Governor of Kentucky.\n(2) Before an application to locate a nuclear waste disposal facility in Kentucky can be\nsubmitted for approval to the Kentucky General A ssembly, it must first receive the\napproval of the secretary of the Cabinet for Health and Family Services and the\nsecretary of the Energy and Environment Cabinet. It shall be the responsibility of\nthe Cabinet for Health and Family Services and the Energy and Environment\nCabinet to ensure that a comprehensive environmental impact statement is\nsubmitted and that public hearings are held in the county in which it is proposed to\nlocate a nuclear waste disposal facility.\n(3) This section shall not apply to nucl ear waste disposal facilities in existence prior to\nJune 17, 1978.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8492","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"19de2be84bfab6e38dc8c80de94bd003cfd4ac1e00cdda414e8514b90c3be20f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.850","next":"us-ky/krs-211.854"},"notice":"GroundRules: Original legal text.
