{"data":{"id":"us-ky/krs-211.862","jurisdiction":"us-ky","citation":"KRS 211.862","heading":"Definitions for KRS  211.861 to 211.869.","body":"As used in KRS 211.861 to 211.869, unless the compact requires otherwise:\n(1) \"Commission\" means  the Central Midwest Interstate Low-Level Radioactive\nWaste Commission;\n(2) \"Cabinet\" means the Cabinet for Health and Family Services;\n(3) \"Compact\" means the Central Midwest Interstate Low-Level Radioactive Waste\nCompact;\n(4) \"Disposal\" means  the isolation of waste from the biosphere in a permanent\nfacility designed for that purpose;\n(5) \"Facility\" means  a parcel of land or site, together with the structures,\nequipment, and improvements on, or appurtenant to, the land or site, that is\nused or is being developed for the treatment, storage, or disposal of low-level\nradioactive waste;\n(6) \"Low-level radioactive waste\" or \"waste\" means  radioactive waste  not\nclassified as high-level radioactive waste, transuranic waste, spent nuclear fuel,\nor by-product material as defined in Section 11e(2) of the Federal Atomic\nEnergy Act. This definition shall apply regardless of any declaration by the\nfederal government or any state that any radioactive material is exempt from\nany regulatory control;\n(7) \"Management  plan\" means  the plan adopted by the commission for the\nstorage, transportation, treatment, and disposal of waste within the region;\n(8) \"Naturally occurring radioactive material\" (NORM)  means any of the primordial\nradionuclides or radioactivity present in soils, rocks, and materials, that are not\nconcentrated or disturbed as a result of human activities;\n(9) \"Person\" means any individual, corporation, business enterprise, or other legal\nentity, public or private, and any legal successor, representative, agent or\nagency of that individual, corporation, business enterprise, or legal entity;\n(10) \"Region\" means  the geographical area of the state of Illinois and  the\nCommonwealth  of Kentucky;\n(11) \"Regional facility\" means any facility as defined in this section that is located in\nKentucky, and established by Kentucky pursuant to designation of Kentucky as\na host state by the commission;\n(12) \"Storage\" means the temporary holding of radioactive material for treatment or\ndisposal;\n(13) \"Technologically enhanced  naturally occurring radioactive material\" or\n\"TENORM\"  means:\n(a) Naturally occurring radioactive material with a radionuclide concentration\nthat has been increased by human  activities above levels encountered in\nthe natural state; or\n(b) Naturally occurring radioactive material made more accessible by human\nactivity.\n\"TENORM\"  does not include the natural radioactivity of rocks or soils or source\nmaterial, byproduct material, or special nuclear material as defined in 42 U.S.C.\nsecs. 2011  et seq. and relevant federal regulations implemented by the\nNuclear Regulatory Commission; and\n(14) \"Treatment\" means  any method, technique, or process, including storage for\nradioactive decay, designed to change the physical, chemical, or biological\ncharacteristics of the radioactive material in order to render the radioactive\nmaterial safe for transport or management, amenable to recovery, convertible\nto another usable material, or reduced in volume.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46515","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"778340738e4b1edced219dc935a25a2c2fb43cb34563572fcf0a4924d8d18128","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.861","next":"us-ky/krs-211.863"},"notice":"GroundRules: Original legal text.
