{"data":{"id":"us-ky/krs-211.865","jurisdiction":"us-ky","citation":"KRS 211.865","heading":"Cabinet's authority to promulgate administrative regulations.","body":"(1) The cabinet shall promulgate administrative regulations to administer and enforce\nthe provisions of KRS 211.861 to 211.869. The administrative regulations shall be\npromulgated with the consultation and cooperation of the commission.\n(2) Administrative regulations promulgated by the cabinet shall prohibit the shipment\ninto or acceptance of low -level radioactive waste in Kentucky if the shipment or\nacceptance would result in a violation of any provision of the compact or KRS\n211.863, 211.865, and 211.869.\n(3) The cabinet may, by administrative regulation, impose conditions on the shipment\ninto or acceptance of low -level radioactive waste in Kentucky that the cabinet\ndetermines to be reasonable and necessary to enforce the provisions of KRS\n211.863, 211.865, and 211.869. The conditions may include, but are not limited to:\n(a) Requiring prior notification of any proposed shipment or receipt of low -level\nradioactive waste;\n(b) Requiring the shipper or recipient to identify the location to which the low -\nlevel radioactive waste will be sent for disposal following treatment or storage\nin Kentucky;\n(c) Limiting the time that low -level radioactive waste from outside of Kentucky\nmay be held in Kentucky;\n(d) Requiring the shipper or recipient to post bond, or by other mec hanisms\nassure that radioactive material will not be treated, stored, or disposed of in\nKentucky in violation of any provisions of KRS 211.863, 211.865, and\n211.869; and\n(e) Requiring that the shipper consent to service of process before shipment of\nlow-level radioactive waste into Kentucky.\n(4) The administrative regulations promulgated by the cabinet may provide for the\ngranting of exemptions, but only upon a showing by the applicant that the granting\nof an exemption would be consistent with the compact.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8503","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"3abcc8b916fc8cdd76c65c58bfbc38e9f70190357ae2768909c7c848f9f85d1c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.863","next":"us-ky/krs-211.867"},"notice":"GroundRules: Original legal text.
