{"data":{"id":"us-ky/krs-211.869","jurisdiction":"us-ky","citation":"KRS 211.869","heading":"Penalties.","body":"(1) Any person who fails to comply with any provision of KRS 211.859 or 211.863, or\nwith any administrative regulations promulgated pursuant to KRS 211.859 or\n211.865, or fails to comply with any order of the cabinet issued pursuant to KRS\n211.859 or KRS 211.863 and 211.865 shall be assessed a civil penalty not less than\nten thousand dollars ($10,000) nor more than one hundred thousand dollars\n($100,000). Each day of the violation or noncompliance shall constitute a separate\noffense.\n(2) Any person who fails to  pay a civil penalty imposed pursuant to subsection (1) of\nthis section, or any portion of that penalty, shall be liable in a civil action in an\namount not to exceed four (4) times the amount imposed and not paid. Any civil\npenalties recovered shall be deposited into the State Treasury and credited to a trust\nand agency fund to be used by the cabinet in carrying out the provisions of KRS\n211.861 to 211.869.\n(3) Any person who intentionally violates a provision of KRS 211.863 shall be guilty of\na Class D felony.\n(4) At the request of the cabinet, the Attorney General shall, on behalf of the\nCommonwealth of Kentucky, bring an action for the recovery of any civil penalty or\nthe prosecution of any criminal offense in violation of KRS 211.863 and 211.865.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8505","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"fb63dcec0a4ab93ef84c56cfc346a1542b6197b65dc90b17445d7294e1b6b955","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.867","next":"us-ky/krs-211.870"},"notice":"GroundRules: Original legal text.
