{"data":{"id":"us-ky/krs-211.892","jurisdiction":"us-ky","citation":"KRS 211.892","heading":"Legislative finding.","body":"It is the finding of the General Assembly of the Commonwealth of Kentucky that the\noriginal concept of shallow-land nuclear burial sites has not been met in Kentucky in that\nmeasurable amounts of radioactivity have been released to the surrounding environm ent\nfrom an existing nuclear waste facility. The mechanism for providing for the financing of\nperpetual care and maintenance of such a site has proven to be inadequate and also did\nnot take into consideration early closing of the site. The detection of rad ioactivity in a\nnew unused trench on such site provided unequivocal evidence that migration of\nradioactive liquids can and did occur in a subsurface manner. Current knowledge of the\ncomplex geologic and hydrologic features of such site is insufficient to d evelop a model\ncapable of predicting future behavior of the site. It is the intent of the General Assembly\nthat because of these problems, the existing site should remain closed unless solutions are\nfound which will assure site safety and integrity and remedy all of the aforesaid problems.\nIt is at this time in the best interest of the public health and safety of the citizens of the\nCommonwealth that the state maintain ownership and, thus, ultimate decision -making\nauthority over nuclear waste sites located within its borders.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8509","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"8c7337f92dbb6bffebf647045e84bbdbe17fe65265b86cf60dedf68b1927ea04","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.890","next":"us-ky/krs-211.893"},"notice":"GroundRules: Original legal text.
