{"data":{"id":"us-ky/krs-211.893","jurisdiction":"us-ky","citation":"KRS 211.893","heading":"Legislative findings relating to naturally occurring radioactive","body":"material (NORM)  -- Required revision of administrative regulations to\nensure  proper management  of oil- and  gas-related wastes containing\nNORM  -- Report to LRC.\n(1) The General Assembly finds that:\n(a) \"Naturally occurring radioactive material\" or \"NORM\"  is a term defined in\nKRS  211.862;\n(b) Certain oil and  gas production and  storage activities result in the\nconcentration or enhancement of the natural radioactivity of rocks or soils\ninto NORM;\n(c) The Cabinet for Health and Family Services, Radiation Health Branch, is\ncharged by KRS  211.842 with responsibility for radiation control in the\nCommonwealth;\n(d) The  Division of Oil and Gas, the Division of Water, and the Division of\nWaste  Management  in the Energy and  Environment Cabinet issue\npermits addressing oil and gas exploration and production operations and\nmanagement  of associated wastes;\n(e) The  Energy and Environment Cabinet, Division of Oil and Gas  was\ndirected in 2003 to promulgate administrative regulations and take all\nactions necessary to ensure efficient oil and gas operations and to protect\nthe property, health, and safety of the citizens of the Commonwealth  in a\nmanner  consistent with KRS Chapter 353;\n(f) The  Cabinet for Health and Family Services is specifically authorized to\nadopt  administrative regulations necessary to implement the Central\nMidwest Interstate Low-Level Radioactive Waste Compact; and\n(g) The  need  for review and  revision of the statutes and  regulations\nassociated with management  of NORM  wastes  is necessary and\nadvisable in order to ensure proper management  and disposal of wastes\ncontaining NORM  generated within or outside the Commonwealth.\n(2) The  Energy and Environment Cabinet and the Cabinet for Health and Family\nServices are directed to exercise their regulatory authority to revise existing\nregulations in order to ensure the proper management  of oil- and gas-related\nwastes containing NORM,  including consideration of such issues as:\n(a) Development  of a manifest system for the transport and disposal of\nNORM  wastes and wastewater;\n(b) Development  of administrative regulations as authorized by the General\nAssembly in KRS 211.865(3);\n(c) Review  of state waste and water permitting programs to ensure proper\nmanagement  of wastes and wastewaters containing NORM;  and\n(d) Identification of and  recommendations  on  any  changes  to existing\nstatutes in order to facilitate management  of oil and gas production\nwastes in a manner commensurate with the risks that those wastes may\npose to the public health and the environment.\n(3) The  Energy and Environment Cabinet and the Cabinet for Health and Family\nServices are encouraged to seek input from oil and gas producers, transporters\nof oil and gas wastes, the public at large, environmental organizations, the\nKentucky  Geological Survey, landfill owners  and  operators, and  the\nConference of Radiation Control Program Directors, among  others, in revising\nthe administrative regulations. The Energy and Environment Cabinet and the\nCabinet for Health and Family Services shall report to the Legislative Research\nCommission  their progress in complying with this section by December  1,\n2016.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44883","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"9a46e223ad1159e8523e5de8718b99ecd5a070e2bd3054509f84ba54b08432cd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.892","next":"us-ky/krs-211.894"},"notice":"GroundRules: Original legal text.
