{"data":{"id":"us-ky/krs-211.896","jurisdiction":"us-ky","citation":"KRS 211.896","heading":"Conditions for reopening of closed facility.","body":"(1) Any nuclear waste disposal facility, licensed and regulated by the Kentucky Cabinet\nfor Health and Family Services, which is closed either because there is doubt as to\nthe public safety of the site, the integrity of the site, the economic feasibility of\nfinancing perpetual care and maintenance and decommissioning of the site, or\ncompliance with cabinet regulations, shall not reopen without:\n(a) A finding of fact by the secretary of the Cabinet for Health and Family\nServices and the secretary of the Energy a nd Environment Cabinet that all\nreasons for site closure have been addressed and resolved such that there is no\nlonger any doubt as to the public safety or integrity of the site or the ability to\nadequately finance the perpetual care and maintenance and de commissioning\nof the site or the compliance of the site with cabinet regulations; and\n(b) A public hearing and the taking of public comment on such findings of fact;\nand\n(c) Approval of a majority of the members of the House of Representatives and a\nmajority of the members of the Senate; and\n(d) Approval of the Governor.\n(2) The Cabinet for Health and Family Services shall be responsible for organizing the\npublic hearings, which shall be held in the county in which the nuclear waste\ndisposal facility is loc ated and shall be at a time and place convenient for public\nparticipation. Adequate notification shall be given to the public of the intention to\nreopen a nuclear waste disposal site and the cabinet shall make available to the\npublic the data and informati on upon which its decision to recommend approval of\nreopening of the site is based.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8511","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"28e2a5d61c3169b63b6f80c52f68be1c290937368e1f38e1bb9521706eb90802","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.894","next":"us-ky/krs-211.898"},"notice":"GroundRules: Original legal text.
