{"data":{"id":"us-ky/krs-211.900","jurisdiction":"us-ky","citation":"KRS 211.900","heading":"Definitions for KRS 211.900 to 211.905 and KRS 211.994.","body":"As used in KRS 211.900 to 211.905 and KRS 211.994, unless the context otherwise\nrequires:\n(1) \"Cabinet\" shall mean the Cabinet for Health and Family Services;\n(2) \"Secretary\" shall mean the secretary for health and family services or his authorized\nrepresentative;\n(3) \"Lead-based hazard\" shall mean levels contained in the federal Residential Lead -\nbased Paint Hazard Reduction Act of 1992;\n(4) \"Dwelling\" shall mean any structure or child-occupied facility, all or a part of which\nis designed for human habitation;\n(5) \"Dwelling unit\" shall mean any room or group of rooms or other interior areas of a\ndwelling or child-occupied facility designed or used for human habitation;\n(6) \"Owner\" shall mean any person who, alone, jointly, or severally with others, has\nlegal title to, charge, care, or control of any dwelling or dwelling unit as owner,\nagent of the owner, or as executor, administrator, trustee, conservator, or guardian\nof the estate of the owner;\n(7) \"At-risk persons\" shall mean all children seventy -two (72) m onths of age and\nyounger and pregnant women who reside in dwellings or dwelling units which were\nconstructed and painted prior to 1978, or reside in geographic areas defined by the\ncabinet as high risk, or possess one (1) or more risk factors identified in  a lead\npoisoning verbal risk assessment approved by the cabinet;\n(8) \"Outreach programs\" shall mean those efforts to locate, screen, and diagnose for\nelevated lead blood levels, those at -risk persons who are not utilizing existing\nscreening and diagnostic  programs or those programs which may be established\nafter June 21, 1974;\n(9) \"Elevated blood lead level\" means any blood lead level greater than or equal to ten\n(10) micrograms per deciliter of whole blood or a level consistent with\nrecommendations by the  Centers for Disease Control and Prevention and the\nAmerican Academy of Pediatrics; and\n(10) \"Confirmed elevated blood lead level\" means a first venous blood lead test or a\nsecond capillary blood lead test taken within the time frames specified by the\ncabinet where the blood lead test result is greater than or equal to fifteen (15)\nmicrograms per deciliter of whole blood.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8513","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"ce9aa19654a3f2608ddee44e5fdba7e9de34ca5332be4a204caf3122f8ddcfad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.898","next":"us-ky/krs-211.901"},"notice":"GroundRules: Original legal text.
