{"data":{"id":"us-ky/krs-211.902","jurisdiction":"us-ky","citation":"KRS 211.902","heading":"Reports on persons with excess level of lead in blood -- Records of","body":"reports to be indexed and analyzed -- Information to local organizations.\n(1) Every physician, nurse, hospital administrator, director of a clinical laboratory,\nor public health officer who receives information of the existence of any person\nfound or suspected to have a two and three-tenths (2.3) micrograms per\ndeciliter of whole blood level of lead in his or her blood shall report the\ninformation to the cabinet within seven (7) days and to the local or district\nhealth officer in approved electronic format as prescribed by administrative\nregulations promulgated by the cabinet in accordance with KRS  Chapter 13A.\nThe  contents of the report shall include but not be limited to the following\ninformation:\n(a) The full name and address of the person tested;\n(b) The date of birth of such person;\n(c) The type of specimen and the results of the appropriate laboratory tests\nmade  on such person; and\n(d) Any  other information about such person deemed  necessary by the\ncabinet to carry out the provisions of this section.\nAny  physician, nurse, hospital administrator, director of clinical laboratory,\npublic health officer, or allied health professional making such a report in good\nfaith shall be immune from any civil or criminal liability that otherwise might be\nincurred from the making of such report.\n(2) Notwithstanding the requirements of subsection (1) of this section, a clinical or\nresearch laboratory shall not be fined or otherwise disciplined for failure to\nreport required information to the cabinet if the information was not provided by\nthe medical professional obtaining the blood sample.\n(3) The  secretary shall maintain comprehensive records of all reports submitted\npursuant to KRS  211.900 to 211.905 and 211.994. Records shall be analyzed\nand  geographically indexed by county annually in order to determine the\nlocation of areas with a high incidence of elevated blood lead levels reported.\nThe  records and analysis shall be public record and provided upon request;\nprovided, however, that the name  of any individual shall not be made  public\nunless the secretary determines that such inclusion is necessary to protect the\nhealth and well-being of the affected individual.\n(4) When  an elevated blood lead level is reported to the cabinet, it shall inform\nsuch local boards of health, local health departments, and other persons and\nhealth organizations as deemed necessary.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46331","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"66448fe1ffd6cc323404843d1f80b51bf205cfe56b76607a9dda396fc4bf3fbf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.901","next":"us-ky/krs-211.903"},"notice":"GroundRules: Original legal text.
