{"data":{"id":"us-ky/krs-211.9061","jurisdiction":"us-ky","citation":"KRS 211.9061","heading":"Definitions for KRS 211.9061 to 211.9079 and KRS 211.990.","body":"For the purposes of KRS 211.9061 to 211.9079 and KRS 211.990:\n(1) \"Child-occupied facility\" means a building, or portion of a building constructed\nprior to 1978 other than target housing in which a child, six (6) years of age or\nunder, spends at least thre e (3) hours a day, two (2) days a week, including but not\nlimited to, child day -care facilities, family child -care homes, pre -schools, and\nkindergarten classrooms;\n(2) \"Department\" means the Department for Public Health;\n(3) \"Lead-hazard detection\" means a n inspection or risk assessment conducted to\ndetermine the existence, nature, severity, and location of lead hazards;\n(4) (a) \"Lead-hazard abatement\" means a set of measures designed and intended to\npermanently eliminate lead hazards in a manner which will  protect children\nand adults from the risk of lead poisoning, including the following:\n1. Removal, encapsulation, or enclosure of lead hazards;\n2. Replacement of lead-contaminated surfaces or fixtures;\n3. Removal or covering of lead-contaminated soil; and\n4. Site preparation and cleanup, preparation of debris for disposal, and\nother post-abatement activities which are conducted at the site and are\nassociated with the abatement.\n(b) \"Lead-hazard abatement\" does not include the following:\n1. Renovation, remodeling, or landscaping activities which are not\ndesigned to permanently eliminate lead hazards, but are designed to\nrepair, restore, or remodel a structure or a dwelling, even though these\nactivities may incidentally result in a reduction o r elimination of lead\nhazards; or\n2. Interim controls, operations and maintenance activities, or other\nmeasures or activities designed to temporarily, but not permanently,\nreduce lead hazards; and\n(5) \"Target housing\" means any housing constructed prior to  1978, except housing for\nthe elderly or persons with disabilities in which no child less than six (6) years of\nage resides or is expected to reside.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8519","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:14Z","sha256":"7b21d2d0e62565d513efc94e60a25af42431666d597276d3af9598293a7a8e4c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.905","next":"us-ky/krs-211.9063"},"notice":"GroundRules: Original legal text.
