{"data":{"id":"us-ky/krs-211.970","jurisdiction":"us-ky","citation":"KRS 211.970","heading":"Definitions for KRS 211.972 to 211.982.","body":"As used in KRS 211.972 to 211.982, unless the context requires otherwise:\n(1) \"Approved\" means that which has been considered acceptable to the cabinet;\n(2) \"Cabinet\" means the Cabinet for Health and Family Services and includes its\nauthorized agents;\n(3) \"Grease\" means fats or oils of animal, vegetable, or mineral origin, separately or in\ncolloidal or dissolved states in combination with soaps, detergents, or food\nparticles;\n(4) \"Grease trap\" means a component designed to separate grease and its constituen ts\nfrom the wastewater stream, provide for storage of separated grease, and discharge\nthe remaining wastewater for treatment;\n(5) \"Holding tank\" means a tank which provides limited pretreatment and storage for\noff-site disposal where site limitations precl ude immediate installation of a\nsubsurface soil absorption system, or connection to a municipal sewer. It also\nincludes portable toilets and similar temporary -use units which contain holding\ntanks;\n(6) \"Person\" means any individual, firm, association, orga nization, partnership,\nbusiness trust, corporation, company, or governmental unit;\n(7) \"Secretary\" means the secretary of the Cabinet for Health and Family Services;\n(8) \"Sewage\" means domestic blackwater and greywater wastes, but does not include\nwaste from industrial or commercial processes;\n(9) \"Sewage pretreatment unit\" means a watertight sewage treatment structure designed\nand constructed to receive raw sewage, separate solids from liquids, digest organic\nmatter through a period of retention, and allow  clarified effluent to discharge to a\nsubsurface soil absorption system. Pretreatment units fall into three (3) basic\ncategories:\n(a) Septic tanks, which rely predominantly on anaerobic bacterial action for\ntreatment;\n(b) Aerobic units, which introduce atm ospheric air into the sewage to promote\ntreatment by aerobic bacteria; and\n(c) Combination units, which provide treatment through both anaerobic and\naerobic bacterial action and mechanical filtering, ozonation, or ultraviolet\nirradiation;\n(10) \"Sewage sludge\" means the solid or semisolid residues which are retained within a\nsewage pretreatment unit or grease trap, as a result of mechanical, hydraulic,\nbiologic, or chemical actions. It also includes raw sewage accepted and stored\nwithin a holding tank;\n(11) \"Site\" means a facility or parcel of land under the ownership of any person which is\nintended for use as the ultimate disposal or treatment location for sewage sludge;\nand\n(12) \"Tank\" means any container placed on a vehicle to carry in transpor t sewage sludge\nremoved from a sewage pretreatment unit, grease trap, or holding tank.","path":["KRS Chapter 211"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8551","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:15Z","sha256":"76968d73414bc1fde1ad87c0f32a51ef2484eca88b67b0ee9ef3585578a2f160","source_id":"us-ky","stale":false,"prev":"us-ky/krs-211.968","next":"us-ky/krs-211.972"},"notice":"GroundRules: Original legal text.
