{"data":{"id":"us-ky/krs-212.275","jurisdiction":"us-ky","citation":"KRS 212.275","heading":"Distribution of nonscheduled legend drugs at health department by","body":"advanced practice registered nurse or registered nurse -- Written policy --\nRecord of prescription drugs -- Responsibility for inventory -- Pharmacist --\nDispensing medication or device prescribed for purpose of causing abortion.\n(1) The governing board for each local, district, and independent health department\nshall have a written policy concerning the distribution of nonscheduled legend drugs\nat the health department by an advanced pr actice registered nurse or a registered\nnurse. In a health department, an advanced practice registered nurse or a registered\nnurse may distribute nonscheduled legend drugs from a list that has been prepared\nby the commissioner of the Department for Public Health. Nothing in this section\nshall be construed to limit advanced practice registered nurses from dispensing\nnonscheduled drug samples under KRS 314.011. Each prescription drug distributed\nor dispensed at the health department shall be recorded in the p atient record. The\ndirector of each health department shall be responsible for keeping track of the\ninventory of stock medications and accounting for the medications dispensed or\ndistributed.\n(2) Only a health department board having within its membership a pharmacist holding\na valid license issued pursuant to KRS 315.030 shall be authorized to permit\nadvanced practice registered nurses or registered nurses to dispense nonscheduled\nlegend drugs according to the written policy of the board. If a health depar tment is\nunable to recruit a licensed pharmacist to serve on the board, the board shall\ndocument consultation with a pharmacist licensed pursuant to KRS 315.030 in the\npublic health practice of the health department.\n(3) No health department shall dispense  any medication or device prescribed for the\npurpose of causing an abortion as defined in KRS 311.720(1).","path":["KRS Chapter 212"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8597","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:15Z","sha256":"3a5b2a8f4df964d3d9c60faa75d25ebdcc2b7d82392c57f0d668cb4d1406b971","source_id":"us-ky","stale":false,"prev":"us-ky/krs-212.270","next":"us-ky/krs-212.280"},"notice":"GroundRules: Original legal text.
