{"data":{"id":"us-ky/krs-212.636","jurisdiction":"us-ky","citation":"KRS 212.636","heading":"Department employees -- Compensation plan -- Merit system -- Personnel","body":"board.\n(1) The board shall establish the compensation plan for all employees of the\ndepartment, and such compensation shall be as nearly comparable as practicable\nwith the compensation paid to and received by employees in comparable agencies.\n(2) The employees of the department shall be employed and governed in accordance\nwith a merit system. The board shall provide for the recruitment, examination,\nappointment, promotion, transfer,  lay-off, removal, discipline, compensation, and\nwelfare of the department's employees by establishing a system of personnel\nadministration based on merit principles and scientific methods whereby the rules\nand regulations of such system shall not be less stringent than those of the merit\nsystem of the Cabinet for Health and Family Services. Such system shall include a\npersonnel board of five (5) members appointed by the board for two (2) year terms.\nThe board shall select as members of the personnel board public-spirited citizens of\nrecognized experience in the improvement of public administration and in the\nimpartial selection of efficient public personnel. The personnel board shall be\nresponsible for establishing rules and regulations for the purpose of g overning the\nadministration of the personnel system. The commissioner shall function as\nappointing authority in and with respect to the personnel matters of the board. The\nboard shall have one (1) year from July 1, 1977, to implement such a system.\n(3) Notwithstanding the provisions of KRS 61.510 to 61.692 and KRS 78.510 to\n78.852, on July 1, 1977, all regular full -time present and future public health\nemployees of the department shall be included within the provisions of the state\nretirement system.\n(4) When the board is qualified and organized as provided in KRS 212.626 to 212.639,\nall city-county department of health employees at that time shall be transferred to\nand continued in the service of the department created under KRS 212.626 to\n212.639. Provided, however, that any and all of such employees who at that time are\nin the classified service of the city-county department of health shall be continued in\nthe classified service of the department with the same status they have had in the\nclassified service of the city-county department of health.","path":["KRS Chapter 212"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8657","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:16Z","sha256":"d9c59e4c11b48651e202bf1afe95a2ec4e67761f3d628e24aa6868417cc60414","source_id":"us-ky","stale":false,"prev":"us-ky/krs-212.635","next":"us-ky/krs-212.637"},"notice":"GroundRules: Original legal text.
