{"data":{"id":"us-ky/krs-213.172","jurisdiction":"us-ky","citation":"KRS 213.172","heading":"Report on prescriptions for abortion-inducing drugs -- Failure to","body":"comply  -- Administrative regulations.\n(1) Each  prescription dispensed by a pharmacy  for RU-486, cytotec, pitocin,\nmifeprex, misoprostol, or any other drug or combination of drugs for which the\nprimary indication is the induction of abortion as defined in KRS  213.011 shall\nbe reported to the Vital Statistics Branch within three (3) days after the end of\nthe month in which the prescription was dispensed, but the report shall not\ninclude information which will identify the pregnant patient involved or anyone\nwho  may have picked up the dispensed prescription on behalf of the woman.\n(2) The report shall include at a minimum:\n(a) The full name and address of the pharmacist or pharmacy dispensing the\nprescription;\n(b) The  names, serial numbers, National Drug Codes, lot numbers, and\nexpiration dates of the specific abortion-inducing drugs that were\ndispensed;\n(c) The full name and address of the referring physician, agency, or service,\nif any;\n(d) The  pregnant patient's city or town, county, state, country of residence,\nand zip code;\n(e) The pregnant patient's age, race, and ethnicity;\n(f) The age or approximate age of the father, if known;\n(g) A  list of any pre-existing medical conditions of the pregnant patient that\nmay  complicate her pregnancy, if any, including hemorrhage, infection,\nuterine perforation, cervical laceration, retained products, or any other\ncondition;\n(h) Whether the pregnant patient was Rh negative and, if so, was provided\nwith an Rh negative information fact sheet and treated with the prevailing\nmedical standard of care to prevent harmful fetal or child outcomes or Rh\nincompatibility in future pregnancies; and\n(i) The  reason for the abortion, if known,  including abuse, coercion,\nharassment, or trafficking.\n(3) The report shall not contain:\n(a) The name of the pregnant patient;\n(b) Common  identifiers such as a Social Security number and motor vehicle\noperator's license number; and\n(c) Any  other information or identifiers that would make  it possible to\nascertain the patient's identity.\n(4) The name of the person completing the report and the reporting institution shall\nnot be subject to disclosure under KRS 61.870 to 61.884.\n(5) (a) Any person or institution who fails to submit a report by the end of thirty\n(30) days following the due date set in subsection (1) of this section shall\nbe subject to a late fee of five hundred dollars ($500) for each additional\nthirty (30) day period or portion of a thirty (30) day period the report is\noverdue.\n(b) Any  person or institution who  fails to submit a report, or who  has\nsubmitted only an incomplete report, more than one (1) year following the\ndue date set in subsection (1) of this section, may in a civil action brought\nby  the Vital Statistics Branch be directed by a court of competent\njurisdiction to submit a complete report within a time period stated by\ncourt order or be subject to contempt of court.\n(c) Failure by any pharmacist or pharmacy to comply with the requirements\nof this section, other than filing a late report, or to submit a complete\nreport in accordance with a court order shall subject the pharmacist or\npharmacy to KRS 315.121.\n(6) Intentional falsification of any report required under this section is a Class A\nmisdemeanor.\n(7) The  Vital Statistics Branch shall promulgate administrative regulations in\naccordance with KRS Chapter 13A to assist in compliance with this section.","path":["KRS Chapter 213"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52241","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:17Z","sha256":"485878442ca7cb762a5b3401ad633857afce652cd57130a9e95b96dc9c3c8c0d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-213.170","next":"us-ky/krs-213.174"},"notice":"GroundRules: Original legal text.
