{"data":{"id":"us-ky/krs-213.174","jurisdiction":"us-ky","citation":"KRS 213.174","heading":"Report  forms  -- Annual  statistical report -- Public records --","body":"Confidentiality of identity -- Communication  of reporting requirements.\n(1) The  cabinet shall create and distribute the report forms required in KRS\n213.101, 213.172, 311.732, 311.7735, 311.7736, 311.774, 311.7741, and\n311.783 within sixty (60) days after April 14, 2022.\n(2) The cabinet shall prepare and submit a comprehensive annual statistical report\nto the General Assembly based upon the data gathered from reports required\nin KRS  213.101, 213.172, 311.732, 311.7735, 311.7736, 311.774, 311.7741,\nand 311.783. The aggregated data shall also be made  available to the public\nby the cabinet in an electronic format.\n(3) Reports required in KRS  213.101, 213.172, 311.732, 311.7735, 311.7736,\n311.774, 311.7741, and 311.783 shall be deemed  public records and shall be\nprovided by the cabinet to the Kentucky Board of Medical Licensure, the\nKentucky  Board  of Pharmacy,  state law enforcement offices, and  child\nprotective services upon request for use in the performance of their official\nduties.\n(4) Absent a valid court order or judicial subpoena, the cabinet, and any other\nstate department, agency, or office or any employees  thereof, shall not\ncompare  data concerning drug-induced abortion or drug-induced abortion\ncomplications or adverse events as defined in KRS  311.7731 maintained in an\nelectronic or other information system file with data in any other electronic or\nother information system, the comparison of which could result in identifying, in\nany manner or under any circumstances, a pregnant patient who is obtaining or\nseeking to obtain a drug-induced abortion.\n(5) Statistical information that may  reveal the identity of a pregnant person\nobtaining or seeking to obtain a drug-induced abortion shall not be maintained\nby  the cabinet or any other state department, agency, or office, or any\nemployee or contractor thereof.\n(6) The  cabinet shall communicate the reporting requirements in KRS  213.101,\n213.172, 311.732, 311.7735, 311.7736, 311.774, 311.7741, and 311.783 to all\nmedical professional organizations, licensed physicians, hospitals, emergency\nmedical service providers, abortion facilities, ambulatory surgical facilities,\npharmacies, and other healthcare facilities operating in Kentucky.","path":["KRS Chapter 213"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52225","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:17Z","sha256":"15d533541dee371c8337b6eb92ad7222780d9e412bfad2ed3d784d4831619d6f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-213.172","next":"us-ky/krs-213.176"},"notice":"GroundRules: Original legal text.
