{"data":{"id":"us-ky/krs-213.991","jurisdiction":"us-ky","citation":"KRS 213.991","heading":"Penalties.","body":"(1) Any person who shall cremate or cause to be cremated or transport or cause to be\ntransported for the purpose of cremation, the body of any person whose death\noccurs in the Commonwealth, without first obtaining from the coroner of the county\nin which death occurred, authorization for the transportation and cremation shall be\nguilty of a Class D felony.\n(2) Any person shall be guilty of a Class A misdemeanor who:\n(a) Willfully and knowingly makes any false statement in a certificate, record, or\nreport required by this chapter or in an application for an amendment thereof\nor in an application for a certified copy of a vital record or who willfully and\nknowingly supplies false information intending that such information be used\nin the preparation of any report, record or certificate or amendment thereof;\n(b) Without lawful authority and with the intent to deceive, makes counterfeits,\nalters, amends or mutilates any certificate, record or report required by this\nchapter or a certified copy of such certificate, record or report;\n(c) Willfully and knowingly obtains, possesses, uses, sells, furnishes or attempts\nto obtain, possess, use, sell or furnish to another, for any purpose of deception,\nany certificate, record or report required by this chapter or certified cop y\nthereof so made, counterfeited, altered, amended, mutilated or which is false\nin whole or in part or which relates to the birth of another person whether\nliving or deceased;\n(d) As an employee of the Vital Statistics Branch or any office designated under\nKRS 213.036, willfully and knowingly furnishes or processes a certificate of\nbirth or certified copy of a certificate of birth with the knowledge or intention\nthat it may be used for the purpose of deception; or\n(e) Without lawful authority possesses any certificate, record, or report required\nby this chapter or a copy or certified copy of such certificate, record, or report\nknowing same to have been stolen or otherwise unlawfully obtained.\n(3) Any person shall be guilty of a Class B misdemeanor who:\n(a) Willfully and knowingly refuses to provide information required by this\nchapter or administrative regulations adopted hereunder;\n(b) Willfully and knowingly transports or accepts for transportation, interment, or\nother disposition a dead body without an acc ompanying permit as provided in\nthis chapter;\n(c) Willfully and knowingly neglects or violates any of the provisions of this\nchapter or refuses to perform any of the duties imposed upon him or her by\nthis chapter; or\n(d) As an employee of the Vital Statist ics Branch or any office designated under\nKRS 213.036, willfully and knowingly violates the confidentiality provisions\nof KRS 213.131.\n(4) Repeated failure to comply with the requirements of this chapter shall be sufficient\ncause for the cabinet to file a report with the applicable medical, dental,\nchiropractic, or funeral director licensure board citing the omissions of lawful duty\nand requesting that appropriate disciplinary action be taken.","path":["KRS Chapter 213"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8771","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:17Z","sha256":"5222ef6b9fd1fc7a7272700d5ca069d9fbf6604bc6f90cd72248550ee5829c50","source_id":"us-ky","stale":false,"prev":"us-ky/krs-213.990","next":"us-ky/krs-214.010"},"notice":"GroundRules: Original legal text.
