{"data":{"id":"us-ky/krs-214.017","jurisdiction":"us-ky","citation":"KRS 214.017","heading":"Caregiver of individual with diabetes may administer or assist with self -","body":"administration of diabetes medications if the caregiver is appropriately trained\nand has the written authorization of the individual's health care practitioner.\n(1) The caregiver of an individual who has diabetes may administer or assist with the\nself-administration of the medication listed under subsection (2) of this section if\nthe caregiver:\n(a) Has been trained to administer insulin and glucagon, recognize the signs and\nsymptoms of hypoglycemia and hyperglycemia, and take appropriate steps to\nrespond to these symptoms by:\n1. A physician who is licensed under the provisions of KRS Chapter 311;\n2. An advanced practice registered nurse, registered nurse, or licensed\npractical nurs e who is licensed under the provisions of KRS Chapter\n314; or\n3. Any other health care professional with diabetes treatment within his or\nher scope of practice; and\n(b) Has the written authorization of the health care practitioner for an individual\nwho has  diabetes. The written authorization shall contain the following\ninformation:\n1. The individual's name;\n2. The name and purpose of the medication;\n3. The prescribed dosage;\n4. The route of administration;\n5. The frequency with which the medication may be administered; and\n6. The circumstances under which the medication may be administered.\n(2) A caregiver of an individual who has diabetes who meets the criteria under\nsubsection (1) of this section may administer or assist with the self -administration\nof:\n(a) Glucagon subcutaneously, to individuals with diabetes who are experiencing\nhypoglycemia or other conditions noted in the health care practitioner's written\nstatement under subsection (1)(b) of this section; and\n(b) Insulin subcutaneously, through the i nsulin delivery method used by the\nindividual and at the times and under the conditions noted in the health care\npractitioner's written statement under subsection (1)(b) of this section.\n(3) The written authorization required under subsection (1)(b) of thi s section shall be\nkept on file by the authorizing health care practitioner.\n(4) The health care practitioner or the caregiver shall inform the individual who has\ndiabetes or the individual's guardian that the health care practitioner, the caregiver,\nor his or her employer shall not incur any liability as a result of any injury sustained\nby the individual from any reaction to any medication listed under subsection (2) of\nthis section to treat a hypoglycemic or hyperglycemic episode or its administration,\nunless the injury is the result of negligence or misconduct on behalf of the health\ncare practitioner, the caregiver, or his or her employer. The individual or guardian\nof the individual shall sign a written statement acknowledging that the health care\npractitioner, the caregiver, or his or her employer shall incur no liability except as\nprovided in this subsection, and the individual or guardian of the individual shall\nhold harmless the health care practitioner, the caregiver, or his or her employer\nagainst any claims made for any reaction to any medication listed under subsection\n(2) of this section to treat a hypoglycemic or hyperglycemic episode or its\nadministration if the reaction is not due to negligence or misconduct on behalf of\nthe health care practitioner, the caregiver, or his or her employer.\n(5) Notwithstanding any other provision of the law to the contrary:\n(a) The administration of the medications listed under subsection (2) of this\nsection by an authorized caregiver shall not constitute the pra ctice of nursing\nand shall be exempt from all applicable statutory and regulatory provisions\nthat restrict the activities that may be delegated to or performed by a person\nwho is not a licensed health care professional; and\n(b) A licensed health care profe ssional may provide training to or supervise a\ncaregiver in the administration of the medications listed under subsection (2)\nof this section.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42949","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:17Z","sha256":"148a6576fa55acb0b5fd4ece0431af63fc771cfd63df00424ad2184830a8703d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.015","next":"us-ky/krs-214.020"},"notice":"GroundRules: Original legal text.
